Ryan Noory/Nori; A Curious Case of Fraudulent DMCA!

Ryan Noory is the chairman of RBNM Group & Strategic Board Advisor and General Counsel for businesses. Even though having years of experience working as an attorney, he is involved in faking the DMCA Law.

Note: Ryan Noory changed his name to Ryan Nori because of our report on lawtally.com, We do not belive how people go, get away with this fraudulent claim of fake dmca.

Attorney Ryan Nori submitted fake DMCA to our hosting provider because we have used his picture (understandably) and his NAME (Does not make sense!). To ensure transparency and good faith among our community members, we are publishing a Transparency Report here.

Ryan Noory's Image removed due to the DMCA

Ryan accused LawTally LLC as a fake and fraudulent profile listing company because we are hosting his profile(How does it make sense?). Apparently, our user submitted factual negative review about him at https://lawtally.com/lawyers/ryan-noory-rbnm/ and its badly affecting his online reputation.

We are fighting to make sure our system does not get impacted throughout the whole DMCA and counter notice review process.

Ryan doctored a fake court order, Hilarious! How come any attorney supposed to file a fake court order, We will be following up with the state bar association. DATE : 26th Nov 2018

UPDATE: Apparently Google has supported Ryan Noory to get him removed from our website because he has a connection(?) with the person who handle the DMCA request in Google’s legal team. This is pure discrimination and we want justice. DATE: 5th Dec 2018

UPDATE: Our internal team has researched that before filing the DMCA request with the GOOGLE. Ryan has copied the profile’s bio information from LawTally.com to Avvo.com to support his DCMA claim. We are so surprised and shocked at the same time to realize that a person with his law degree from the Harvard can go down to this length of SCAM. DATE: 10th Dec 2018

The site is allegedly owned by a Mr. “Cameron Taylor” under an alleged name of “Law Tally LLC” neither of which has any records nor is registered in the United States of America. There is neither a telephone number nor address associated with this company.

As I have been notified by Cloudfare that you are the host of record associated with this fraudulent site (please see exhibit B below), I would like to place you on notice that they have created a fake profile under my name without my consent.

I have tried reaching out multiple times to have the unauthorized use of my picture, name and website contents removed however I have had no success (please see exhibit C and D below).

The site administrator always respond to the valid request, Apparently if you read all the exhibit, Ryan himself submitted listing for the claim.

His client whom he scammed, reported review on his profile, Ryan tried every way to delete that review and does not care about his client.

Since we are a very transparent website, We shall not allow this scammer to get away with it.

He is telling LawTally LLC is a fraudulent website however he should first check on his claim.

We are not going to remove a single line of statement from the page and we strongly ask linode team to support us here.

We need a court order and subopena to serve him further.

Ryan submitted the claim for the profile listing by himself.Only the thing is we have used his image from the Justia.com and he is not the legal owner of the site.Use of images is fair and we are giving credit for the same. If he wish to go ahead with the court of the law, we are ready to take it further.Please read the above thread for our response. Hey there,

You’ll need to file a counter notice but before we can accept the counter-notice, you’ll need to remove the content from your page.

Once you produce a valid counter-notice, if ten days go by with no further legal action from the complainant you will be able to restore access to the content. However, if the complainant pursues further legal action then you won’t be able to restore access to the content until the legal issue is resolved.

Our attorney said, We should remove the image and that is what considered to be the valid DMCA claim. Kindly notify the party involved.

However, we would like to file the counter notification against Ryan Noory to make sure we prove that the use of image is can’t be confirmed as a copyright issue.

I just wanted to update you a bit.

Previously you said that use of his image was from Justia.com. While he may not own the website, he claims to own the image itself which he submitted to Justia on his own. This claim states that your use of the content which he owns is unauthorized.

All content that was mentioned in the DMCA must be removed before we can accept the counter notice:

“Unauthorized use of Ryan Noory’s name, picture, and web contents
without consent.”

In order to satisfy DMCA, this material must be taken down in order for us to accept the counter notice.

Once the counter notice is received, then the ten(10) day window begins for the complainant to respond. As stated in the original update including the DMCA, access to the material must not be restored until directed.

Please let us know if you intend to provide the counter notice.

We don’t want to go for the counter notification. As per the law only the copyright claim has to be submitted for the images, We are not going to remove that bastard profile from our site. He is such a pain.

Either, Allow us that profile on our site or allow us week of time to change the hosting, Our site focuses on lawyers listing profile and if we remove everyone profile due to negative reviews removals, We are dead.

We have already removed his image from our site.

We are fine to host our site on offshore hosting and that being said Linode is to biased and scared of simple claim.

I am loosing trust on you guys.

I apologize, as Angelo stated, the DMCA takedown notice provided claims more than just the image. Specifically the claimed content is:

“Unauthorized use of Ryan Noory’s name, picture, and web contents
without consent.”

In this case, it appears the content of his profile on your website is copied from a different location. We ask that you expeditiously remove this content in order to fully comply with the DMCA. While I can understand your frustrations, we must work in accordance with our legal requirements. If you wish to bring the content back up you will need to file a counter-notice.

You will need to remove the content from the website while the counter notice is processed. The counter notice will serve as your response to the DMCA. Once provided, the complainant is entitled to respond. In the event that they do not, or the response is not satisfactory we will notify you that the content can be restored.

– No, We have not copied any content from any site, its our works that we have completed in house. Please check for plagiarism and if you found a single sentence has been copied from any site, We are happy to remove whole page but not in case when we are legit.

– Only the issue was to deal with the image. Use of name is not an unauthorized. Please work on that.

– We know the law, If the name was trademarked, Than we were liable for the removal of the name.

– The Copyright Act states that names, titles, short phrases and expressions cannot be registered in the U.S. Copyright Office.

First off, thanks very much for your patience and understanding in this matter. Please know that Linode is not biased against you or your business. We take customer advocacy very seriously, and in fact, it was only after Cloudflare disclosed your IP and your hosting information before Linode began engaging with Mr. Noory.

Second, please be aware that I am not a lawyer and that Linode is unable to provide you with legal guidance or opinion. However, it appears that you have significant knowledge of regarding the areas of U.S. copyright laws and the DMCA. As such, you know that all ISPs like Linode are required to forward DMCA takedown notices to subscribers.

I am equally frustrated at the lack of guidance U.S. law has provided for instances where a DMCA claim may be ambiguous. However, I did want to bring 17 U.S. Code § 512(f) (of the DMCA) to your attention in the event that you believe Mr. Noory’s DMCA takedown notice is false or misrepenstative:

Misrepresentations.—Any person who knowingly materially misrepresents under this section—

(1) that material or activity is infringing, or
(2) that material or activity was removed or disabled by mistake or misidentification,

shall be liable for any damages, including costs and attorneys’ fees, incurred by the alleged infringer, by any copyright owner or copyright owner’s authorized licensee, or by a service provider, who is injured by such misrepresentation, as the result of the service provider relying upon such misrepresentation in removing or disabling access to the material or activity claimed to be infringing, or in replacing the removed material or ceasing to disable access to it.

To this end, if you believe Mr. Noory’s claim, attached to this email for your convenience, to be false or misrepresentative, we would kindly ask that you provide Linode with a counter-notice to forward to Mr. Noory and to remove Mr. Taylor’s page for 10 days, pending Mr. Noory’s response. You and Mr. Noory would then be free to discuss this matter at length or proceed with legal action.

My understanding of the elements of a counter-notice are generally as follows, though you should definitely review 17 U.S. Code § 512(g)(3) with your attorney for a complete picture:

Hello,

To file the counter-notice for the DMCA, you can attach the file to the ticket, or respond to the ticket with the counter-notice. In order for the counter-notice to be valid, it must include the following:

– A physical or electronic signature of the customer.

– Identification of the material that has been removed. If it has not been removed, the counter-notice is not valid.

– A statement under penalty of perjury that the customer has a good faith belief that the material was removed or disabled as a result of mistake or misidentification (i.e., fair use, etc – not our game, they just have to state it under penalty of perjury).

– The customer’s name, address, and telephone number, and a statement that the customer consents to the jurisdiction of Federal District Court for the judicial district in which the address is located, or if the subscriber’s address is outside of the United States, for any judicial district in which the service provider may be found, and that the subscriber will accept service of process from the person who provided notification or an agent of such person.

We would then be able to pass the counter-notice along to the complainant , and if the complainant does not pursue legal action within ten (10) business days, you may restore access to the content. The sad part is that the google has supported his DMCA violation report and has removed the page from its search index.

On top of that, Google has even removed this transparency report and that is the reason why we had to file the counter notification.

    I think, you should sue them over the filing of the fake DMCA. You will at least get a compensation of 16K USD. I am ready to take up this case and would charge only when we won the case.
