Adam C. Ragan is a “five-tool player” and trusted problem solver who focuses his practice on safeguarding the interests of clients in the financial services, oil and gas, and energy industries.

Adam has extensive experience defending financial institutions in state and federal courts, including first-chair responsibility for all phases of trial-court litigation and arbitration. He routinely defends his clients against claims under the “alphabet soup” of consumer statutes. In recent years, Adam has dedicated a significant portion of his time to helping clients navigate the constantly changing TCPA litigation landscape—both in individual cases and class actions.

Since joining Hunton Andrews Kurth LLP, Adam has expanded his litigation and counseling practice to touch on a variety of industries key to the Texas market.

As a former secondee to a large loan servicer, Adam appreciates the internal decision points that may impact the handling of a given case or project. He prides himself on offering responsive, thoughtful advice and strives to tailor each representation to meet his client’s immediate and long-term strategic objectives.

Recognizing these objectives do not begin or end with a single case, Adam also regularly collaborates with his colleagues to advise clients on how best to limit exposure to costly litigation and regulatory proceedings.

Adam began his career as a judicial law clerk to the Hon. David R. Farmer, whom he considers an early mentor, in the Tennessee Court of Appeals.

He has since handled appeals in the Texas Courts of Appeals, the United States Court of Appeals for the Fifth Circuit, and the United States Court of Appeals for the Sixth Circuit.

Adam is admitted to practice in Texas, Tennessee, each of the United States District Courts for Texas and Tennessee, the United States Court of Appeals for the Fifth Circuit, and the United States Court of Appeals for the Sixth Circuit.

Adam is a certified information privacy professional (CIPP/US).

Experience:

  • Represented major pipeline company seeking $40 million in damages against a producer of raw NGL mix that rejected the applicable, long-term purchase agreement during its Chapter 11 bankruptcy.
  • Represented international oil company and its US affiliate in a trade secrets dispute involving fracking technology in which a preliminary injunction was granted and subsequently affirmed in a per curiam order.
  • Represented metal refinery in state court and Chapter 13 bankruptcy following an alleged theft of $1.7 million in precious metals, defeating an emergency motion enforce automatic stay that would have required client to return precious metal obtained via agreement with the debtor.
  • Defended insurance agency against claims of fraud, conversion, violation of the Texas Deceptive Trade Practices-Consumer Protection Act, and violation of the Texas Insurance Code in connection with lapsed coverage discovered after a fatal accident at the plaintiff’s construction site.
  • Won trial as first-chair counsel for general contractor litigating competing claims for breach of contract and damages.
  • Represented student loan servicer in lawsuits and arbitrations seeking damages under the Telephone Consumer Protection Act.
  • Represented mortgage servicers in wrongful foreclosure, breach of contract, and fraud actions in Texas and Tennessee.
  • Represented mortgage servicers in bankruptcy adversary proceedings claiming violations of the discharge injunction.
  • Defended retailer against putative class action involving alleged violations of the Telephone Consumer Protection Act’s telemarketing provisions.
  • Succeeded on early motion to dismiss a borrower’s claims against a student loan servicer under the Fair Credit Reporting Act with prejudice.
  • Drafted successful motion to dismiss a borrower’s claim against a student loan servicer under the federal False Claims Act.
  • Drafted and successfully argued motion to vacate a summary judgment wrongly requiring a national bank to pay more than $100,000 to the estate of a deceased account holder.
  • Obtained summary judgment for title company defending alleged violations of the home equity loan provisions of the Texas Constitution, fraud, negligent misrepresentation, and breach of contract.
  • Provided advice and counseling to Texas transmission-only electric utility in connection with contract and litigation matters.
  • Advised student lender on compliance with federal and state laws governing application and origination of refinance loans.
  • Counseled mortgage servicers when responding to requests from the Consumer Financial Protection Bureau (CFPB).
  • Assisted mortgage servicer with response to a state attorney general’s inquiry into foreclosure billing practices and vendor management.
  • Participated in a multi-month, on-site remediation project to address concerns raised by the Office of the Comptroller of the Currency (OCC) in connection with foreclosure fees and costs.
  • Acted as oversight counsel in escalated consumer financial services cases throughout the country to ensure timely resolution of strategically significant issues and emergencies.
