Allison Kahn defends employers in discrimination and retaliation matters in state and federal court. She represents entities of all sizes across sectors including health care, banking, telecommunications, and education. Allison regularly appears before the U.S. Equal Employment Opportunity Commission, U.S. Department of Labor, and Florida Commission on Human Relations.
She litigates claims involving discrimination based on race, religion, sex, and other protected characteristics (Title VII); sex-based discrimination in education (Title IX); and the Americans with Disabilities Act (employment discrimination, reasonable accommodations, and access), Age Discrimination in Employment Act, Fair Labor Standards Act (wage and hour), Family and Medical Leave Act, Fair Housing Act, Whistleblower Protection Act, and Florida Civil Rights Act. On behalf of her brokerage firm clients, she also litigates employment disputes before FINRA.
To help employers take a proactive approach that reduces the risk of litigation, Allison counsels them on managing discrimination and harassment complaints, employee discipline, and termination issues; provides opinions and recommendations regarding both employee pay classifications (exempt/non-exempt), and structuring internship programs under the Fair Labor Standards Act; and presents onsite employee training sessions regarding employment laws.
At the employer’s request, she also conducts investigations into employee claims of discrimination and advises the employer of her findings and recommendations. Her knowledge of workplace law extends to fast-evolving issues such as those related to sexual orientation and gender identity under Title VII, and employees’ increasingly aggressive reasonable accommodation requests under the Americans with Disabilities Act. She regularly writes and speaks on legal developments that affect her clients.
Allison was drawn to the practice of labor and employment law because it involves complex workplace relationships, and stories with a human component. Beyond her practice, she applies her investigatory skills to her work as an appointed member of The Florida Bar Grievance Committee, which is charged with investigating claims of attorney misconduct.
Early in her career, she clerked for the Honorable Gary Farmer at Florida’s Fourth District Court of Appeal. This experience broadened her understanding of the practical considerations that shape court decisions, and informs her practice today.
