Amie V. Colby represents clients in the energy industry before the Federal Energy Regulatory Commission (“FERC”). Amie has particular experience with vertically-integrated utilities and transmission-related issues, including transmission rate cases, compliance with open access transmission tariff (“OATT”) provisions, FERC regulations related to Standards of Conduct (“SOC”), national and regional reliability standards and OASIS posting requirements.

In addition, due to increased focus on the development of renewable energy, Amie has examined FERC’s transmission and interconnection queuing practices as well as the Public Utility Regulatory Policies Act of 1978 (“PURPA”) and FERC’s QF and EWG regulations.

Representative Matters :

  • Provided counsel to utilities involved in regional transmission organization (“RTO”) and independent system operator negotiations.
  • Represented and counseled electric utilities in FERC transmission rate cases involving both stated and formula rates, including litigation.
  • Led review of transmission transactions and compliance with OATT and FERC regulations. Counseled utilities regarding interpretation and implementation of the utilities’ open access transmission tariffs.
  • Provided advice to utilities on FERC’s incremental pricing policy including filing of a transmission service agreement with incremental pricing.
  • Reviewed and negotiated wind energy interconnection agreements for several investor owned utilities.
  • Regulatory Counsel to utilities before a FERC Administrative Law Judge; including taking depositions, drafting testimony and drafting briefs.
