Andrew D. O’Brien focuses his practice on patent preparation and prosecution, formulating global intellectual property strategy for industry-leading, flagship products and providing insightful and strategic portfolio counseling. Shook’s expansive and varied IP practice initially provided him with broad experience in many aspects of U.S. and foreign utility and design patent practice, as well as trademark prosecution and prelitigation counseling.
He now concentrates on partnering with clients to assess protection of consumer-focused products and services through multiple IP tools, including creative utility and design patent claiming strategies.
Much of Andy’s practice concentrates on utility and design patents for metamaterials and engineered textiles for use in athletic equipment, apparel and aerodynamic footwear, including drag-reduction systems launched and showcased across various international stages, including Olympic competitions.
He also works with patents for consumer goods and the automotive industry, including work on dynamic mechanical linkage systems, advanced manufacturing techniques, electromechanical connections and software.
He also has drafted and prosecuted U.S. and foreign patent applications in GUI flow and functionality, search-engine optimization and other computer-related innovations and telecommunications.
His work in portfolio counseling includes helping to lead, supervise, and execute a plan that increased one client’s annual patent filings by 300 percent over the course of two years.
His goal is to help his clients grow their businesses, creating and implementing inception-to-grant processes for design patent applications—including product evaluation and claiming analysis, draftsman oversight and management, foreign-filing strategy determination, application preparation and filing in U.S. and foreign jurisdictions, application prosecution and post-allowance assessment.
