M. Andrew Holtman, Ph.D., has extensive experience challenging and defending patents in post-grant proceedings at the U.S. Patent and Trademark Office (USPTO), litigating in district courts, representing clients in appeals before the U.S. Court of Appeals for the Federal Circuit, and counseling clients on due diligence and freedom-to-operate issues.
Andrew is one of country’s most active patent attorneys before the Patent Trial and Appeal Board (PTAB) of the USPTO and has been involved in over 50 inter partes reviews (IPRs) since the start of 2015, acting as lead counsel in the majority of his cases. He also represents clients before the Federal Circuit in appeals stemming from PTAB decisions.
He has significant experience coordinating multi-jurisdictional patent practice between the United States, the European Patent Office (EPO), and numerous European court systems. He has overseen litigations in France, Germany, Ireland, and the United Kingdom, as well as oppositions at the EPO.
Andrew has considerable experience with due diligence investigations, particularly in the pharmaceutical and diagnostics field. He manages teams of attorneys performing comprehensive freedom-to-operate, validity/enforceability, and ownership investigations. In addition, he teaches advanced courses on due diligence, and frequently lectures on litigation practice with an emphasis on evolving Federal Circuit law.
The subject matter of Andrew’s work involves many different technologies, including gas turbofan engines, hybrid vehicle technology, and pharmaceutical formulations. His extensive experience also covers most biotechnology-related fields, such as plant molecular biology, genetics, biochemistry, and immunology, as well as medical devices and other biomechanical technologies.
Before entering the practice of law, Andrew served as a research fellow at Rutgers University, where he focused on molecular genetics. His work involved identification and molecular characterization of genetic operons associated with fungal parasitism. Andrew also served as a research associate for an immunology corporation, studying coat-protein and cellular interactions of HIV and corresponding screening assays.
