Andrew Q. Leba focuses his practice on complex patent litigation before Federal District Courts in Hatch-Waxman actions and other patent infringement matters. His practice spans a broad range of technologies and products, including athletic wearables, financial technology (FinTech), pharmaceuticals, and chemicals.
Andrew has litigated a diverse range of technologies, including wireless communications technology, wearable technology, image processing and mobile banking technology, payment systems, banking systems, insulin glargine products, medical devices, topical pharmaceutical formulations, antiemetic cancer drugs, ulcerative colitis drugs, and epilepsy drugs.
Encompassing all aspects of litigation, from the initial pleading stage through trial, his experience includes developing infringement and validity strategies; developing claim construction positions and technology tutorials in preparation for Markman hearings; drafting a wide range of motions, pleadings, and briefs; assisting technical experts with preparation of expert reports; preparing expert witnesses for depositions and court; and developing trial strategies.
Andrew is also involved in representing clients in post-grant proceedings before the U.S. Patent and Trademark Office (USPTO), including inter partes review (IPR) proceedings.
Andrew maintains an active pro bono practice, in which he has first-chaired civil litigation cases and handled all aspects of trial, from opening arguments to closing arguments, and obtained complete victories at both trial and appellate levels. Most recently, he has represented unaccompanied children seeking asylum in the immigration system.
Prior to joining Finnegan, Andrew worked at a large, multinational law firm. He also served as a judicial intern to the Honorable Amy M. Totenberg, U.S. District Court for the Northern District of Georgia, and the Honorable Jorge A. Solis, U.S. District Court for the Northern District of Texas.
