Anthony P. Tatum focuses on policyholder insurance coverage matters and related complex commercial disputes. As a partner in our Insurance Coverage and Recovery Practice, Tony represents leading public and private companies on all aspects of insurance and related commercial contract disputes, including insurance for directors and officers; errors and omissions; cyber/data privacy; property damage; business interruption; environmental/ pollution; commercial general liability; employment practices; fidelity and crime coverage; rep and warranty; product recall; and other manuscripted lines of coverage.
Tony has litigation experience in state and federal courts, and in handling both domestic and international arbitrations. Tony’s current and recent representations include handling matters on behalf of such leading companies as First Horizon National Corporation, International Hotel Groups, LLC, Kimberly-Clark Corporation, SavaSeniorCare, Shell Oil Company, SunTrust Banks, Inc., and The Coca-Cola Company.
Tony has represented clients in recovering over $2 billion in insurance assets as a result of both litigation and pre-litigation resolutions, including almost $350 million in recoveries since 2015. Tony also has represented numerous clients in commercial contract disputes regarding related indemnification and additional insured obligations.
In addition to contested insurance and complex commercial disputes, Tony advises clients and their boards of directors regarding D&O indemnification and insurance issues, as well as data privacy/cyber insurance matters. He also routinely assists clients in negotiating best-in-class terms and conditions with U.S. and international insurers for all lines of insurance coverage, as well as on merger and acquisition deals that involve long-tail claims, representation and warranty insurance, and other insurance and indemnification related issues.
Tony also obtained a notable multimillion verdict after a three-week jury trial in federal court for a company that sustained a large industrial property damage and business interruption loss. The jury verdict included a finding of bad faith against the property insurance company. (Trade Am International Inc. v. The Cincinnati Ins. Co., Civil Action No. 1:08-cv-03711-ECS).
Tony obtained his undergraduate degree in Risk Management and Insurance from The University of Georgia. He later worked as a senior analyst with two leading financial services firms in the area of regulatory insurance compliance before graduating, cum laude, from Georgia State University College of Law. He was a law clerk for the U.S. Attorney’s Office, Department of Justice, and an extern for former Georgia Congressman Ed Jenkins. Tony is frequently invited to speak on insurance coverage and related litigation topics, and has authored numerous publications.
