Benjamin P. Browder advises a broad spectrum of clients in the real estate industry on the acquisition, disposition, leasing and financing of their real estate assets, which regularly include multifamily apartment complexes, retail centers, office buildings, land, hotels and golf courses.

He is also well known for his work with private equity investment, structuring and entity formation.

Experience:

• Represented global private equity funds in real estate related investments and joint ventures. This representation covers not only the real estate aspects of these investments, but also includes the structuring, negotiating and forming of limited partnerships, limited liability companies, joint ventures, and corporations to own real estate and other assets.
• Represented lenders and borrowers in real estate financing including loan transactions involving all product types and subsequent workouts and foreclosures, and representing purchasers of performing and nonperforming notes, loans, and loan portfolios from banks, private sellers and governmental agencies.
• Represented both landlords and tenants in retail, restaurant, office and industrial lease transactions.
• Represented a global private equity firm in multiple real estate acquisitions and financings, with collateral in multiple jurisdictions throughout the United States, totaling in excess of $5,500,000,000 and various real estate product types ranging from multifamily, office, retail, industrial and hotel assets.
• Represented a global private equity firm in $500,000,000 acquisition and financing of performing and subperforming loan portfolio, with collateral in multiple jurisdictions throughout the United States, including multitier debt structures for various loan relationships.
• Represented a global private equity firm in $125,000,000 acquisition and financing of performing, subperforming and nonperforming franchise loan portfolio, with collateral in multiple jurisdictions throughout the United States.
• Represented a global private equity firm in multiple loan portfolio acquisitions totaling more than $25,000,000 from banks and private sellers, with collateral in multiple jurisdictions throughout the United States.
• Represented a global private equity firm in multiple loan portfolio acquisitions totaling more than $30,000,000 from governmental agencies, with collateral in multiple jurisdictions throughout the United States.
• Represented a global private equity firm in one-off disposition transactions aggregating in excess of $1,000,000,000 for various real estate product types, including office buildings, shopping centers, multifamily properties and restaurants in multiple jurisdictions throughout the United States.
• Represented a global private equity firm in multiple loan portfolio disposition transactions in excess of $57,000,000, with collateral in multiple jurisdictions throughout the United States.
• Represented a global private equity firm in $90,000,000 financings of over 75 restaurant properties throughout the United States.
• Represented a global private equity firm in $43,000,000 acquisition and financing of a hotel portfolio with properties in multiple jurisdictions throughout the United States.
• Represented a national industrial developer in 6,000-acre land assemblage, financings and corresponding industrial development surrounding Union Pacific intermodal facility.
