
Brad M. Elbein brings over thirty years of prominent experience in consumer and finance law and public policy including issues relating to the automotive marketplace, advertising, and UDAAP cases. Prior to returning to private practice, Mr. Elbein served as a Regional Director in two of the Federal Trade Commission’s regions, directing first the Southwest Region and then the Southeast Region.
In his almost two decades at the FTC he investigated and litigated hundreds of federal consumer cases. Mr. Elbein’s current practice includes representing companies in the internet marketing and consumer financial services industry. He advises and defends participants in the internet marketing, affiliate marketing, credit and debt industries, lenders, and other businesses.
In the debt and credit sectors, Mr. Elbein represents debt buyers in FDCPA litigation. He recently represented a company being prosecuted by the CFPB, as well as a group of debt buyers fighting the attacks of private class action counsel, and debt buyers and debt collectors in private litigation. He also recently served as an expert witness in a federal court case involving the purchase by a debt buyer of a portfolio of debt from a private seller: my testimony was instrumental in helping settle the case favorably.
In the auto arena, Mr. Elbein’s goal is to provide smart, cost-effective compliance advice and litigation defense for motor vehicle dealers. With his background at the FTC and his experience working both with and against government agencies such as CFPB, he provides clients with a unique perspective about what’s going on behind the scenes at the regulatory agencies.
Mr. Elbein represents various motor vehicle dealers and he has completed a compliance audit for a national motor vehicle lender. He’s actively involved in Georgia’s automobile dealers’ associations, giving advice and counsel and consulting on members’ challenges.
In the new and developing area of Internet marketing and affiliate marketing, Mr. Elbein represents companies on compliance with federal law, responses to regulatory inquiries and consumer complaints, and defense strategies when sued by regulators. Mr. Elbein has also held leadership positions in the Resolution Trust Corporation and the Federal Deposit Insurance Corporation. Over the years he has been a frequent lecturer for state attorneys general offices on multiple topics including data security and privacy.
