Brian Chang

Brian Chang’s practice focuses on patent litigation and IP counseling. He has experience in complex patent matters involving technologies such as medical devices, network management software, cellular phones and mobile devices, semiconductors, HVAC systems, computer hardware and software, and electronic commerce.

In addition to patent litigation in the federal courts and International Trade Commission, Mr. Chang regularly assists the firm’s transactional practice groups with IP due diligence. He is also active in the firm’s USPTO post-grant practice, regularly preparing or supervising petitions for inter partes review and covered business method review proceedings.

Litigation Experience:

• Prepared and managed covered business method review challenges on behalf of eBay and PayPal, in which the PTAB invalidated 40 challenged claims of three patents relating to electronic currency transactions.
• Responsible for day-to-day technical analysis and managing expert witnesses in an on-going patent infringement suit between competing manufacturers of HVAC systems.
• Member of Weil team that represented Medtronic in Federal Circuit appeal concerning lifesaving heart valve replacement technology, in which the Weil team successfully secured a stay of a preliminary injunction that had been entered by the district court.
• Responsible for prior art searching, technical analysis, developing invalidity positions, and coordinating expert witnesses in a patent infringement suit filed against General Electric in the Eastern District of Virginia, concerning RFID-based monitoring of hand-washing in hospitals and medical facilities.

Mr. Chang has also performed IP due diligence in numerous transactional matters, including in connection with Weil’s representation of:

• Intel’s $16.7 billion acquisition of Altera.
• Eli Lily’s acquisition of Novartis Animal Health.
