    RIde Sharing Accident

    I was driving on my way to work last June when a ride sharing service car cut me off trying to make a right turn from the middle lane, struck my car and ultimately ending up pushing me into another vehicle. My car was deemed totaled and I was at a loss at what steps to take next. After a recommendation from a coworker to pursue legal action I was introduced to Brian.

    Best there is

    Brian Breiter represented me following a car vs. bicycle collision. The short of it is that driver misconduct resulted in my upper jaw being fractured and displaced, multiple front teeth damaged or lost requiring extensive dental work including wiring to set the bone and multiple root canals, and vascular and nerve injury to my dominant hand. While my hand recovered full functionality following extensive physical therapy, my mouth was permanently disfigured. He did a phenomenal job. The highlights:

    – He took over after another attorney stopped communicating with me, despite that attorney having a lien on any award. What a difference between the two! Brian was 100x better from the first day, and was in constant communication. No extra charge, minimal hassle to fire my first attorney and bring on Brian.
    – Through skilled work during witness deposition, he managed to get the defense to admit liability. Initially they had contested it.
    – He advised rejection of inappropriately low settlement offers, eventually taking the case to trial. He accurately estimated the worth of the case at a number close to the final jury award.

    Over 3 years ago my husband had a massive car accident driving with my teenage son. The impact was so severe that his hand smashed into the windshield, and immediately ballooned up. However, that was the least of our problems, after his hand started to heal he realized he had a severe knee injury that eventually needed surgery.     The Best of the Best

    Brian Breiter is the best there is. This will be a highly detailed review, so I’ll list some highlights for those who don’t want to read the full story.
    -I was rear ended by a businesses Mercedes Sprinter van in November of 2014 causing herniated discs in my neck and back
    -For nearly 3 years, Brian and his team followed my treatment closely, checked in on me regularly, and handled all communication with the defendant and their insurance company, allowing me to focus on my recovery
    -A few very low settlement offers were rejected, forcing us to go to trial in November of 2017
    -After only an hour of deliberation, the jury came back with a settlement that was over 10 times the last offer
    -Brian and his team not only provide 5 star results, they genuinely care about their clients
    -Brian’s kindness, compassion, and dedication to his clients is immeasurable.
    The Accident 
    On Saturday, November 29th 2014, I was on my home to LA from Orange County after celebrating Thanksgiving with my family. I’d been stopped for a minute or so when all of the sudden, there was a loud crash followed by a violent jerk forward. I looked in my rear view mirror to see the Mercedes logo and the grill of a van the size of an airport shuttle essentially in the back seat of my Honda Civic. Shortly after we’d pulled over, the driver of the van asked if I minded if he got off of the freeway, he’d just spoken to his bosses, they told him it was “bad for business” to have the company van on the side of the road. My husband arrived soon after this, once he saw the damage he insisted on taking me to the emergency room to get checked out. That was the first of 2 ER visits, followed by multiple appointments with an orthopedist, 2 MRIs, an anesthesiologist who gave me 3 epidural injections in my neck, several trigger point injections in my back, and countless hours of physical therapy over the span of nearly three years to treat my symptoms. (Burning in the base of my neck and lower back, hip pain, intermittent tingling in both arms and legs, severe muscle spasms in my back and neck). I had to come to the difficult realization that I will be in pain for the rest of my life as a result of this crash, and will eventually need surgery on my neck to repair the herniated disc.

    The Case
    After continued attempts to reach a settlement, no reasonable offers were made by the Defendant. We had no choice but to go to trial.

    TRIAL
    I knew Brian was an excellent attorney, but any expectations I had were exceeded beyond belief when we entered the courtroom. Brian and his Associate, CJ Pardon, were well prepared, treated each of the jurors with the utmost respect and consideration, and demonstrated complete and total professionalism. Brian’s opening statement, assisted with a PowerPoint presentation (prepared by CJ Pardon), was powerful, it moved me to what would be the first of many tears shed during the trial. On the second day, my doctor took the stand to explain the anatomy of the spine, the details of my injuries, my course of treatment, and walked the jury through the steps of the operation I’ll inevitably have to have to repair the disc in my neck. My husband took the stand next, answering Brian’s questions to show who I was before the crash, to explain his experience of the day of the crash and the changes he saw in me as a result of the consistent pain I have been in for the last few years. I took the stand last, I was terrified. Brian’s ability to be direct while taking a witnesses comfort into consideration caused my fear to dissipate. When the defendant’s witness attempted to discredit my injuries and my character, Brian shut him down. When the time came, his closing argument was even more compelling than his opening. He explained to the jury that the numerous underhanded tactics used by the defense were just plain wrong. The defense made their closing arguments and the attacks to my integrity were blatant. During Mr. Breiter’s rebuttal, his anger at the defenses statements was unmistakable. He answered back in a big way, all the while maintaining professional composure. With that, the jury was sent to deliberate. After one hour of deliberation, the jury came back with a nearly unanimous verdict of a settlement over ten times more than the last offer received from the defendant.
    I think it goes without saying that the last 3 years have been an unbelievable roller coaster. There aren’t enough words to properly articulate how thankful my husband and I are for Brian and his team. The amount of support, devotion, and hard work put into this case is truly immeasurable. I would never wish injury onto anyone, but if you are injured and need help, Brian is the person you want on your side. My life changed forever in November of 2014, thanks to Brian and his team, my life changed for the better 3 years later and we are eternally grateful.

    Literally the best

    In October of 2013, I was crossing the street near my own home in LA when I was hit by an SUV.

    Nothing can prepare you for something like that. The is no step by step guide for what to do next.
    All I knew is I needed help. I needed someone to help me go through this as the car that hit me did not call for help and did not report what happened. The driver also did not give me any information other than a name and phone number which went straight to voicemail every time I tried calling.

    I was clearly hurt, I was limping and falling and since no one arrived at the scene when I was hurt, I was basically advocating for myself, which I found out, is VERY difficult to do after such a traumatic event.

    Before I found Brian Breiter, I found myself being sent home from the er hospital and doctor multiple times with a pat with the words I know it is painful to get hit by a car but I would feel better soon since I am younger than 40 years of age.

    This dance lasted until my own health insurance had enough complaints to referred me to an orthopedic doctor. I finally got an appointment to see the orthopedic doctor a week after thanksgiving. The moment the orthopedic doctor laid eyes on me, he inquired why no one was helping me go through this.

    I didn’t even realize what I was going through was wrong. I knew I needed help but I couldn’t find someone who would listen to my pleas.

    My orthopedic doctor let me know I needed 3 MRIs. The sooner the better.

    Unfortunately, since I was going through my own insurance, the doctor informed me I could receive the referrals for MRIs by maybe January of the following year. I bursted into tears in the orthopedic doctor’s office. I already wasn’t sleeping because of the pain. My body wasn’t working correctly. I had a family I needed to take care of but no one seemed to care. No one could give me answers.

    Fantastic Experience Top to Bottom

    Approximately 4 and a half years ago, I was subjected to dangerous conditions at a restaurant that resulted in a life changing injury to my face. I was forced to undergo plastic surgery to attempt to alleviate the damages, but I was left with permanent scarring, numbness, and an overwhelming sense of helplessness.

    With no experience in a courtroom and without ever filing a lawsuit, I was unaware of any possible options. While squatting down sorting through a pile of clothing, a Pilates reformer (a 6’8″ 38.5 lb bench) which was improperly secured came crashing down on her head. She remained conscious, but blacked out for a bit and “saw stars”. At first we had no idea the severity of the injury, but after a few days of the symptoms (nausea, neck pain, blurred vision, loss of dexterity in hand, general confusion, inability to suffer light or noise, radiating pain down the arm, severe headaches and migraines) getting progressively worse we knew that this was a serious injury that needed immediate attention. Still unable to get an appointment after calling dozens of Neurologists I was lost and needed help, this is when I called Brian who helped us get into see a Neurologist a day or so later. After seeing a number of specialists my Wife was diagnosed with a Mild Traumatic Brain Injury (mTBI), and was put on a daily dosage of Nortriptalyne and given Maxalt for acute treatment of the Migraines. After the first six months a number of the physical symptoms had gone away with the exception of crippling migraines, she was still only a fraction of herself.

    THE CASE
    Again, we had no idea the extent of my Wife’s injuries but knew we were going to need to retain legal counsel after I visited the Pilates studio where the accident occurred, and the Owner denied the accident happening. My Wife was suffering, our medical bills were adding up and now I have a sociopath calling me a fraud and promising to send my Wife and I to jail – this is when Brian became my friend and attorney. We went through two mediations (June and Sept 2016) with no reasonable offers being presented – we steel ourselves for trial with a date set for June 2017.

    TRIAL
    This is where Brian and his team (Partner – Steve Hoffman, Associate – Jeff Twomey) truly shone. As a witness I was not able to be in the courtroom until my testimony, so I was not present for the first 3 days of trial. I felt dejected that I could not be in the courtroom to support my Wife, but knew Brian and his team was there for her. Finally, on day 4 it was my turn to take the stand and tell our story, Brians direct line of questioning allowed for me to do just – many tears were shed. The last day of trial allowed me to watch Steve Hoffman dismantle and discredit the Defense Neurologist (later dubbed “Mr Reliable”), helped by Brians keen observation of this Doctor speaking with another Defense Attorney during the morning break. While I felt confident that the Jury saw that we were telling the truth, I was concerned that they were falling for some of the Defense’s underhanded tactics and well-coached and paid for expert witnesses. This concern was alleviated after Brian’s closing arguments, where he laid out the case through a series of perfectly crafted slides (prepared by Jeff Twomey) highlighted by his ability to connect with the Jurors. Brian’s final rebuttal effectively wiped out Defense’s closing arguments, the trial was over. After 2.5 hours, the Jury unanimously sided with us delivering a verdict ten times what Defense has proposed.

    All said it has been a wild 2.5 years, but can tell you at numerous times throughout my Wife and I both said thank g-d for Brian. He helped us through a difficult time, kept us laughing when we wanted to cry and ultimately delivered the best possible result from a terrible situation. I am usually reluctant to offer recommendations/referrals, but in this case I can wholeheartedly and without concern tell you that should you or a loved one find yourself in a similar situation call the Law offices of Brian Breiter – you will not find a more caring or competent group.

    On October 27, 2015, my brother was riding his bike home from the beach. He was almost home, When he made his way to go under the bridge at the same time there was a semi going under the bridge and his load on his truck was too high and clipped the top of the bridge and the container fell off the truck and onto my brother,killing him instantly.

    A few years ago my mother, who is in her 70s, was rear ended violently by a work truck.     Three and a half years ago, many aspects of my life changed in an instant. I was struck on the head by an unsecured pilates reformer board while simply shopping at a clothing sample sale at a pilates studio. I didn’t “pass out” as many expect one would from being struck on the head. At the time, I actually thought I was fine and proceeded to drive home and continue on with my day, only thinking that I had some neck pain.

    As the week went on, things got a bit worse. I was diagnosed with a concussion the next morning and proceeded to go downhill as the week continued. My husband watched me as I was unable to care for my three kids and didn’t know what to do. Concussions were unchartered territory for us so he called an old friend Brian Breiter for guidance. Brian wouldn’t give my husband, Adam, any legal advice at all, even though that’s his area of expertise. He said there wouldn’t be any discussion of legal terms until we figure out my medical situation as health comes first. He advised Adam to get me to the ER where then I was advised to go to a neurologist.

    We attempted several times to settle with the defense to no avail.     The jury, with only a short two hour deliberation, unanimously sided with us and awarded us more than ten times the amount that the defense ever offered in any mediation.

    Mauled by pitbull

    Brian and his team came to my rescue after I was mauled by a pitbull. Professionally I have dealt with insurance companies before and one thing I have learned is to call a lawyer when personal injuries are involved. It can and does get complicated very quickly. Brian was able to settle with the insurance company in a timely manner and get my medical bills paid on time. Medical bills can mount quickly especially when specialists are brought in to fix your body.
