Brian A. Wadsworth is an associate in the Houston office of Seyfarth Shaw LLP. He is a member of the Labor and Employment practice group. Brian represents clients in federal and state court, arbitration, and before administrative agencies such as the U.S. Equal Employment Opportunity Commission (EEOC) and the Texas Workforce Commission (TWC) in connection with all aspects of employment litigation—from inception through trial or arbitration.
He has represented clients in single plaintiff and class action litigation, defending against claims brought under Title VII, the ADA, the ADEA, and the FMLA. Recently, Brian secured summary judgment on behalf of a client in a single plaintiff gender and race discrimination claim brought under Title VII.
Brian also represents companies in collective and class actions involving claims for unpaid compensation under the FLSA and analogous state laws. Brian has experience managing the discovery process for collective actions brought for unpaid wages and in responding to requests for conditional certification.
In addition to representing clients under federal and state employment statutes, Brian also represents clients in state and federal court on non-compete issues. Brian has represented both employers seeking to enforce non-compete agreements and employees who have had a lawsuit filed against them.
Prior to joining Seyfarth Shaw LLP, Brian served as a Captain in the United States Army. During his service, Brian deployed to the Iraqi theater of operations and was awarded a Bronze Star. Following law school, Brian practiced employment and commercial litigation at both Bracewell & Giuliani, LLP and Edison, McDowell & Hetherington, LLP.
