Brian S. Whittemore focuses his practice in insurance law, with particular emphasis on insurance coverage, including among other lines D&O, E&O, tech, cyber, general liability, property, in the primary, excess and reinsurance context.
Mr. Whittemore counsels London Market and other international insurers on scope of coverage, monitoring and settling underlying litigation by third parties, advice on wordings, as well as litigating disputed coverage claims.
Mr. Whittemore also has substantial experience advising financial service professionals on compliance issues, banking operations and institutional risk management and has counseled some of the nation’s largest commercial banks, consumer finance companies, mortgage lenders and related entities on these complex issues.
Mr. Whittemore has particular experience defending financial institutions in banking operations litigation relating to Articles 3, 4, and 4A of the Uniform Commercial Code, the Electronic Funds Transfer Act (Reg E), FCRA, RFDCPA, FDCPA, RESPA, TILA, and UDAP claims.
Mr. Whittemore has also successfully resolved borrower actions alleging lender liability, wrongful foreclosure, title and lien priority disputes, and loan origination, loan securitization, loan servicing claims, as well as violation of state and federal statutes.
Prior to joining Hinshaw & Culbertson LLP in March 2017, Mr. Whittemore was in private practice at several other San Francisco bay area law firms and represented financial institutions, domestic and international insurance companies, national mortgage lenders and finance professionals in defending mortgage banking and loan servicing litigation in state and federal courts.
