
Bryan P. Sugar is a partner in the Chicago office of Lewis Brisbois and a co-chair of the Intellectual Property & Technology Practice. Mr. Sugar’s practice focuses on the administration of domestic and international trademark registration programs, intellectual property issues in acquisitions and secured transactions, and litigation and counseling involving copyrights, trademarks, patents, domain names, e-commerce, licensing, rights of publicity and rights in computer software and databases.
Mr. Sugar specializes in trademark, copyright, and unfair competition law, and has significant experience with United States federal court litigation. Mr. Sugar also specializes in proceedings in the United States Patent and Trademark Office before the Trademark Trial and Appeal Board; UDRP Internet domain name disputes; corporate trademark licensing; entertainment; publishing; mergers and acquisitions; intellectual property audits; and the development of corporate trademark enforcement programs.
In his technology transactional practice, Mr. Sugar has represented clients in the negotiation of many technology transfer, license and procurement agreements. These include ASP and “cloud computing” agreements, outsourcing agreements, data processing agreements, development agreements, non-disclosure agreements, non-competition agreement, non-solicitation agreements, professional services agreements, support services agreements, service-level agreements (SLA), license agreements, asset purchase agreements, referral agreements, strategic alliance agreements, distribution agreements, manufacturing agreements, sales agreements, development agreements, invention agreements, and equipment lease agreements.
In addition to his Intellectual Property practice, Mr. Sugar also represents clients in relation to data privacy and cybersecurity. He assists clients in the development and drafting of incident response plans, including the identification and involvement of key stakeholders, the acquisition of cyber liability insurance, the facilitation and execution of Master Service Agreements with breach response service providers, and introduction to appropriate law enforcement personnel.
He also manages clients’ responses to information security incidents, including initial assessment of problem; facilitation of legal agreements and services to contain, analyze, investigate and remediate a data compromise; assessment of consumer and regulatory notification obligations; drafting of consumer and regulatory notification; and responding to inquiries from the media and regulatory officials. Should litigation arise from the incident, Mr. Sugar defends clients against third party demands as well as class action complaints.
