Charles L. Coleman III has more than 30 years of litigation and trial experience, with significant emphasis on aviation and other transportation matters. Mr. Coleman has acted as lead counsel in numerous high profile cases for major domestic and international corporations in aviation and other industries, including insurance, defense, telecommunications, transportation, logistics, tourism and computer software.
Mr. Coleman is accustomed to dealing with disputes that are multi-jurisdictional in scope, including product defect claims, Warsaw Convention/Montreal Convention claims and cross-border transactional disputes.
These disputes have involved jurisdictional challenges, forum non conveniens issues, choice of law issues, contractual interpretation, arbitration clauses, and the application of foreign law and jurisdiction.
Mr. Coleman places early emphasis on analyzing damage claims and, where appropriate, working with forensic accounting experts to defeat inflated damage claims presented by opposing parties.
Mr. Coleman’s aviation experience includes the following:
- defending airlines and manufacturers in significant aircraft-casualty and wrongful-death matters
- defending the owner of a meteorological (“MET”) tower in a wrongful death action brought by the survivors of an agricultural pilot whose aircraft struck the tower
- defending a complex, multi-billion dollar wrongful death claim brought by the heirs of a leading Brazilian industrialist who perished in a helicopter accident.
- defending an international air carrier in multi-district litigation proceedings in San Francisco involving “deep vein thrombosis” claims
- local counsel for firm team defending Air France in MDL proceedings in San Francisco arising from AF447 (Brazil mid-Atlantic) crash
- defending actions for injuries due to alleged exposure to asbestos in aircraft components
- defending product-liability actions involving property damage and the economic loss doctrine
- defending product-liability actions involving property damage and the economic loss doctrine
- representing secured creditors against other creditors
- aircraft leasing disputes
Mr. Coleman has published scholarly articles in the areas of products liability, transportation, federal preemption and other topics and has spoken to a number of professional bodies. Most recently, he has presented accredited CLE seminars on lessor liability issues under 49 U.S.C. § 44112. From 1975 through 1977, Mr. Coleman served on active duty as an officer in the U.S. Navy Judge Advocate General’s Corps. During that time, he tried scores of criminal cases.
