Cody Gillians

Cody I. Gillians is an Intellectual Property associate in Mayer Brown’s Washington DC office. His experience focuses on patent litigation in federal district courts and proceedings before the US Patent and Trademark Office.

Cody has experience prosecuting patent applications for surgical supplies, semiconductors, business methods, and solar power systems fields. His patent litigation experience include managing electronic discovery, drafting Markman briefs, drafting motions, and a jury trial.

Cody is also registered to practice before the US Patent and Trademark Office in patent cases and has experience preparing and filing inter partes patent reexaminations and petitions for covered business method reviews.

Cody’s technical knowledge covers a range of fields including: medical devices, 3G and 4G wireless communication standards, telephone networks, business methods related to converting loyalty points, video streaming and compression techniques, USB devices, and other fields in the electrical and mechanical arts.

Prior to his career as an attorney, Cody worked for nine years at IBM in Research Triangle Park as a hardware design engineer and technical project manager. In his role as design engineer, he primarily designed and tested circuit boards for high performance servers and programmed VHDL code for use on those servers.

Later, as a technical project manager, he managed the development, testing and distribution of network adapters developed by Broadcom and Intel, among others, and deployed throughout IBM’s server portfolio.

Experience :

• Masimo Corporation v. Philips Electronics North America Corporation. Representing Philips against Masimo’s claims of patent infringement related to pulse oximetry technology and Philips’ counterclaims of patent infringement and antitrust violations. The case involves 24 patents and is pending in the United States District Court for the District of Delaware.
• Loyalty Conversion Systems Corp. v. American Airlines Inc., et al. Represented five airlines against Loyalty Conversion’s claims of patent infringement related to a computer-based method for converting airline customers’ loyalty award credits.
• JSDQ Mesh Technologies LLC v. Aruba Networks Inc. Represented Aruba Networks against JSDQ’s claims of patent infringement related to methods of call routing and connection. The case was settled shortly after claim construction.
