Dana B. Briganti focuses her litigation practice in the defense of consumer and class action claims and disputes. She is involved in all phases of the litigation process, from inception to trial, in both state and federal courts, including discovery, taking and defending depositions, substantive and procedural motion practice, oral argument, trial preparation and appellate practice. Dana also handles consumer finance matters/mortgage related litigation.
In addition to her consumer and class action practice, Dana also has substantial experience in complex insurance coverage and insurance defense, including the evaluation of claims, evaluation reports, fact and liability analysis, defense strategies, and recommendations and coverage determinations for insurance carriers.
Prior to joining Hinshaw & Culbertson LLP, Dana was an associate with another New York firm where she furthered her litigation and insurance defense experience.
During law school, Dana interned at two New York firms and was a summer associate at a third. Her law school accomplishments include having been a quarter finalist in the First Year Moot Court Oral Argument Competition. She was a member of the Dean’s List and served as a Student Bar Association representative and a BAR/BRI representative.
Representative Matters : In the Appellate Division, Second Department, Dana successfully argued that an insurance agency was not liable to its client, regardless of whether the agency provided timely notice of loss to the insurer, where the insurer issued two separate policies of insurance that covered the loss, but only disclaimed coverage under one policy.
Since the insurer failed to disclaim coverage under the second policy of insurance, the insurer was required to afford coverage to the insurance agency’s client for the loss, thereby relieving the agency from any claim for damages suffered by its client. – Lancer Ins. Co. v. Louis Provenzano, Inc., et al., 101 A.D.3d 687, 955 N.Y.S.2d 377 (2nd Dept., 2012).
