
Daniel A. Powell brings a wealth of litigation experience to Minc Law’s internet defamation practice. He has worked on numerous internet-related cases on behalf of clients from across the country and globe, implementing the firm’s unique processes and techniques to bring relief to individuals and companies whose reputations and brands have been attacked and injured online.
Since joining the firm, Daniel has focused his practice exclusively in the area of internet defamation. His professional experience includes advocating for his clients in various state and federal courts.
He has served as lead counsel on behalf of his clients in jury trials, bench trials, arbitrations, mediations, administrative hearings, and appellate proceedings. His many successes have included six and seven figure trial verdicts rendered in his clients’ favor, including verdicts awarding punitive damages and attorney fees in addition to compensatory damages.
Daniel also has a stellar track record in obtaining temporary, preliminary, and/or permanent injunction relief for clients who require immediate relief and/or whose damages could not be properly compensated solely through a monetary award.
In addition to his trial resume, Daniel is highly knowledgeable and experienced in the area of appellate advocacy, having represented his clients in a multitude of appellate venues.
On appeal, he has obtained reversals of adverse rulings and has also successfully defended favorable judgments in both federal and state court proceedings, including but not limited to the Ohio Supreme Court and the U.S. Sixth Circuit Court of Appeals.
As a member of the Minc Law team, Daniel has had outstanding success in removing web pages which contain false and defamatory information about his clients, causing the de-indexing of such content from the search results of Google and other internet search engines, and obtaining identifying information on individuals who anonymously authored and published the false information on the internet.
Relevant to the firm’s focused practice area, he has negotiated non-disparagement agreements and other complex settlements, won court orders compelling the forensic examination of individual’s computers and extraction of the metadata contained on the hard drives, and provided counsel to various entities and individuals who have been subjected to or threatened with malicious online attacks.
