
Mr. Daniel C. Herbert’s practice is devoted exclusively to Family Law. He handles all varieties of divorce cases from the very simple to the very complex. He graduated from the University of San Diego in 1982 with a degree in accounting and received his law degree from the University in 1986.
Mr. Herbert seeks to resolve matters in a cost effective and amicable manner to avoid incurring legal fees that diminish the value of the marital estate. However, he remains prepared to go to trial if that is necessary.
His trial experience includes litigating the issues of support, property division, custody, visitation and virtually every other type of issue arising in Family Law. He understands, and is sensitive to, the financial and emotional strain associated with custody matters and possesses unique and creative abilities regarding the division of property given his education and experience.
If a matter must go to trial, he provides aggressive and effective representation while keeping in mind the cost, and potential outcomes, for his clients. As is the case in all matters, his clients are kept well-informed and are advised of all of their options.
Mr. Herbert has served as a mediator and has been appointed to over 200 cases by judges of the Superior Court. Mr. Herbert is also referred cases by other lawyers when those cases become too large or complex.
He has served as a Judge Pro Tempore with the Superior Court and has acted as a settlement conference judge in many cases. He has been invited to address groups of all kinds in matters related to Family Law and served as the primary instructor in Family Law at the Naval Justice School’s California Legal Assistance Course.
