Daniel C. Cooley helps companies protect, leverage, and defend their intellectual property. He handles litigation at both the trial and appellate level, with an emphasis on proceedings in U.S. district courts, post-grant proceedings at the Patent Trial and Appeal Board (PTAB) of the U.S. Patent and Trademark Office, and appeals to the U.S. Court of Appeals for the Federal Circuit.
Dan handles all aspects of litigation, including pre-suit diligence, case strategy, discovery, depositions, dispositive and non-dispositive motion practice, and appeal. He served as a law clerk to the Honorable S. Jay Plager at the U.S. Court of Appeals for the Federal Circuit, and has participated in more than 20 Federal Circuit matters, arguing several as lead counsel.
He has also participated in a significant number of post-grant proceedings, including reexamination, inter partes review (IPR), and covered business method (CBM) proceedings. He has written petitions and patent owner responses, deposed and defended expert witnesses, argued motions, and argued at the oral hearing.
He is a coauthor of the The Practitioner’s Guide to Trials Before the Patent Trial and Appeal Board, Second Edition, published by the American Bar Association, Section of Intellectual Property Law.
Dan also provides opinions of counsel and clearance investigations for a variety of mechanical and electrical technologies, including medical devices, heavy machinery, gas turbines, on-road and off-road vehicles, outdoor products, business methods, imaging devices, feedback control systems, computer networking, internet technology, and other computer-related technologies.
Prior to joining Finnegan, Dan helped design and build an MRI-based cancer treatment system. He constructed radio-frequency imaging coils and developed algorithms and software to perform parameter identification for the treatment system’s model predictive controller.
As an engineering student, he helped design a tool for inserting a micro-electrode array into the brain for a company involved in neural decoding, sensing, and stimulation. Dan represents on a pro bono basis veterans pursuing appeals for disability claims. He is listed on the Capital Pro Bono Honor Roll.
