
Daniel Lust, an associate in the General Liability Practice Group, focuses his practice on defending personal injury and property damage litigation throughout New York State.
Dan focuses a signficant portion of his practice on high-exposure high-profile transportation matters, including bus and commercial truck incidents involving fatalities, catastrophic injuries, and multi-vehicle collisions. He also handles a wide variety of premises liability matters.
With substantial experience in e-discovery, Dan has built countless successful defenses utilizing information captured from plaintiffs’ social media accounts and networks, finding the digital “needle in the haystack” to crack open difficult cases. His colleagues have frequently asked him to step in to assist with or lead legal or social media research into very unique and challenging issues.
Because of his experience and success in this area, Dan has become a leading a commentator on the evolving legal implications of social media platforms and their use in various contexts, frequently publishing and presenting on the subject.
Dan also has experience in the sports and entertainment law arena. Before and during law school Dan served legal internships focusing on MLB arbitration with the SFX Baseball Agency and the Excalibur Sports Group, and spent four years as public relations coordinator for the New York Giants.
After earning his bachelor’s degree in Philosophy at Union College, Dan went on to earn his J.D. at Fordham University College of Law.
He served as associate editor of the Fordham Environmental Law Review, president of the Fordham Sports Law Forum, and founder of the National Negotiation Competition, and took part in multiple trial advocacy, sports arbitration, and sports negotiation competitions.
Dan gained additional experience through internships with the New York State Supreme Court in Westchester County and a post-graduate fellowship with the Nassau County Attorney’s Office.
