Darrel C. Karl devotes a substantial portion of his practice to litigating intellectual property cases, primarily patent infringement lawsuits, and to counseling clients on related matters. In addition to patent cases, he has litigated cases involving issues of trade secret misappropriation, breach of contract, unfair competition, and related torts.
Darrel’s patent suits have involved such diverse technology as protective automobile glass, lasers used to remove plaque in heart canals, liquid scintillation counters, and polyclonal assays for detecting pregnancy, hepatitis, and other medical conditions.
His responsibilities as a litigator have included everything from the development of legal strategy and the preparation of briefs and motion papers to the examination of witnesses and the presentation of oral arguments in court.
In addition, Darrel frequently advises clients and consults with other law firms on issues of patent law and procedures at the U.S. Court of Appeals for the Federal Circuit.
Darrel’s ligation experience includes litigating a series of complex biotechnology patent infringement lawsuits involving over a dozen patents in the field of recombinant DNA protein manufacture and a series of related cases at the U.S. International Trade Commission (ITC) and in U.S. district courts to exclude the importation and to prevent the sale of infringing neodymium-iron-boron magnets. He has also handled inter alia litigations involving water cooler technology and shape-memory metal eyeglass frames.
Darrel has advised clients on various issues of contract interpretation and licensing law, and has drafted and negotiated numerous agreements involving the settlement of litigation and/or the licensing of patents and related know-how. His background in physics has also proved helpful in the prosecution of patents in the fields of semiconductors, solar cells, flight magnetometers, and magneto-optical recording media.
