Dave Roberts

Dave Roberts is a litigator who specializes in civil litigation matters for pharmaceutical and medical device makers, health insurers, and other consumer-oriented businesses. His practice focuses on defending clients against product liability and consumer class action claims in cases involving parallel or related government enforcement activities.

Dave has written numerous appellate and trial court briefs on dispositive issues such as federal preemption and evidentiary issues involving regulatory and scientific evidence. Dave’s experience spans several federal courts of appeals and district courts, as well as multiple state appellate and trial courts.

Experience:

• Appellate preservation counsel in complex litigation involving product liability claims over client’s medical devices; results include full affirmance of favorable summary judgment and directed verdict rulings in first MDL bellwether trial in Lewis v. Johnson & Johnson, 601 F. App’x 205 (4th Cir. 2015)
• Briefed and argued case in Fourth Circuit as court-appointed pro bono counsel, convincing court  that individual’s criminal conviction did not make individual removable from country in Mena v. Lynch, 820 F.3d 114 (4th Cir. 2016)
• Representing athlete, promoter, and others in consumer class actions involving alleged failure to disclose athlete’s health condition
• Defended pharmaceutical company in state and federal courts against product-liability claims
• Defended electronics company in class actions and individual suits alleging antitrust violations, resulting in voluntary dismissals by all plaintiffs
• Represented company in federal and state appellate courts regarding employment classification of delivery truck owner-operators
• Represented health insurance companies in payment disputes with health care providers
