David Fitzmaurice is an associate in Weil’s Complex Commercial Litigation and Appellate Litigation practices, where he focuses on antitrust, commercial, constitutional and patent disputes. Mr. Fitzmaurice has briefed and argued cases at both the trial and appellate levels.
Mr. Fitzmaurice’s notable recent experience includes serving as a member of the Weil trial team that secured a complete defense jury verdict for C&S Wholesale Grocers in a multi-hundred million dollar antitrust class action.
Mr. Fitzmaurice was also a member of the Weil trial team representing Breitburn Energy Partners in connection with its chapter 11 bankruptcy proceeding, which culminated in the confirmation of Breitburn’s chapter 11 plan after a week-long confirmation and evidentiary hearing in the Southern District of New York.
Mr. Fitzmaurice is a member of the Weil team representing Bridgestone in the ongoing Auto Parts antitrust multi-district litigation class action lawsuit.
Mr. Fitzmaurice maintains an active pro bono practice. Most recently, he was a member of the Weil team that obtained a significant civil rights victory for Mexican-American students against the state of Arizona.
The Weil team proved at trial that an Arizona state statute banning ethnic studies programs in public schools was both enacted and enforced with discriminatory intent in violation of the Fourteenth and First Amendments, and the court ultimately enjoined any further enforcement of the statute.
Mr. Fitzmaurice has also represented indigent criminal defendants in their direct appeals of their criminal convictions in New York state appellate courts.
Mr. Fitzmaurice joined Weil following his clerkship with the Hon. Paul A. Crotty in the U.S. District Court for the Southern District of New York.
He has also clerked for the Chief Judge of the Irish District Court, Rosemary Horgan, and he has interned with the Hon. Anthony J. Scirica in the U.S. Court of Appeals for the Third Circuit.
