David Morrison

C. David Morrison focuses his practice in the area of labor and employment and has over 36 years of experience in employment counseling, including supervisory training. He has tried over 80 cases and arbitrations, and has argued over 20 appeals before state and federal appeals courts. He was the firm’s Labor Department Chair for sixteen years.

EXPERIENCE:

• Won a jury trial for a large chemical manufacturing company in a case brought by seven women alleging sex discrimination and an Equal Pay Act violation
• Obtained summary judgment in two cases where the federal district court was asked to overturn labor arbitration awards
• Provided many training sessions to employees of clients on various HR topics, including EEO matters, harassment, documentation, investigations, hiring and interviewing, and factors to consider before firing
• Handled union elections in wood products, aluminum products, chemical, retail, health care, natural gas, coal and hospitality industries
• Obtained state and federal court injunctions for illegal strike activity in the chemical, tire manufacturing, coal, natural gas, trucking, wood products and aluminum products industries
• Investigated numerous instances of workforce misconduct by employees in the health care, coal, and oil and gas industries
• Provided training on employment issues at banks, hospitals, coal mines, manufacturing companies, and gas compressor stations in West Virginia, Virginia, Maryland and Kentucky
• Defended retaliatory discharge and discrimination claims in health care, chemical, auto sales, aluminum products, retail, wood products, legal, high tech, education, banking, natural gas, coal, pharmaceutical and other industries
