David Prueter’s practice includes all aspects of intellectual property and technology, with a particular focus on patent law. David prepares and prosecutes patent applications with the US Patent and Trademark Office (USPTO) in the mechanical, electro-mechanical and glass manufacturing industries. He frequently provides patentability, infringement, freedom to operate and invalidity opinions, and conducts patent challenge proceedings, including inter partes review, before the Patent Trial and Appeal Board.
David assists in trade secret misappropriation matters and patent infringement disputes in state and federal district courts, as well as importation of protected goods and unfair trade practices involving intellectual property at the US International Trade Commission (ITC) and patent-related appeals at the US Court of Appeals for the Federal Circuit.
David counsels the patent departments of many domestic and international companies to secure both domestic and foreign patent protection. David has extensive experience preparing original patent applications for filing in the USPTO and prosecuting patent applications by responding to office actions from the USPTO.
He also has experience drafting patent applications to be filed in various foreign jurisdictions, including Japan, Korea, China, Taiwan and countries of Europe. David regularly communicates with foreign legal counsel to respond to office actions from the Japan Patent Office, Korean Intellectual Property Office, State Intellectual Property Office of the People’s Republic of China, Taiwan Intellectual Property Office and European Patent Office.
Prior to entering the practice of law, David worked as an engineer for a government contractor, where he focused on the design and analysis of manufactured components for defense related purposes, including nuclear propulsion systems for naval submarines and aircraft carriers.
