David has extensive experience arguing before the Patent Trial and Appeal Board (PTAB) of the U.S. Patent and Trademark Office (USPTO), having represented petitioners and patent owners in dozens of inter partes review (IPR) proceedings. He also has substantial experience with reexamination proceedings.
A substantial portion of David’s practice is also dedicated to developing and managing global utility and design patent portfolios. David has prosecuted hundreds of utility and design applications, and frequently provides opinions on patent infringement and validity.
He conducts due diligence pre-litigation analysis and portfolio reviews, and consults with clients regarding potential patent infringement claims, patent monetization opportunities, and offensive and defensive strategies.
In addition to his patent office and counseling practices, David has experience with pre-trial strategy, motion and brief practice, and handling discovery disputes in matters before U.S. district courts. Contentious PTAB trials often run in parallel with district court litigations, and David coordinates the strategies and positions taken in both.
David served at the USPTO as a patent examiner and later a primary examiner, handling U.S. and international patent applications in various mechanical and electromechanical technologies concerning transportation and construction hardware, systems, and assemblies.
His technical background spans a wide array of subjects with an emphasis on mechanical and electrical technologies. He represents clients in an expansive range of industries, including automotive, industrial manufacturing, computer, Internet, communications, display, imaging, consumer electronics, medical devices, sports equipment, and amusement rides.
David’s pro bono work includes representing an army veteran in an appeal to the U.S. Court of Appeals for Veterans Claims and representing an asylum seeker in an affirmative asylum proceeding at the U.S. Department of Justice.
