Diana C. Surprenant assists clients in the oil and gas, construction, manufacturing, hospitality, health care and pharmaceutical arenas. She advises employers in state and federal courts, arbitration proceedings and in administrative proceedings before the Equal Employment Opportunity Commission and the Louisiana Commission on Human Rights. In addition, she represents health care providers in medical malpractice suits.
In her employment defense work, Diana helps clients defeat or resolve claims filed under Title VII of the Civil Rights Act of 1964, the Americans with Disabilities Act, the Age Discrimination in Employment Act, the Family and Medical Leave Act, the Uniformed Services Employment and Reemployment Rights Act and the Fair Labor Standards Act. She also defends them against claims for retaliation and unpaid wages under state and federal law.
At the appellate level, Diana maintains an active post-trial motion practice and drafts appellate briefs stemming from toxic tort litigation and medical malpractice litigation. She also applies for emergency supervisory writ applications before the Louisiana appellate courts. At trial, Diana often draws on her appellate experience to preserve objections.
When she previously clerked for Judge Jay C. Zainey in the US District Court, Eastern District of Louisiana, Diana gained great admiration for the judge’s ability to use his legal abilities and knowledge to improve the lives of those in the surrounding community and inspire lawyers to do the same.
Diana is an active member of the Young Friends of St. Andrew’s Village, an organization that helps people with special needs. She also provides legal consultation and notary services through the Homeless Experience Legal Protection program. Diana also serves as President of the ABA/EEO Committee for Liaison with the EEOC, DOJ, and OFCCP, which offers continuing legal education seminars in the field of labor and employment.
