Douglas McWilliams’ practice encompasses all areas of environmental counseling with an emphasis on air permitting, enforcement and rule development. Douglas has particular experience in the mobile source sector, navigating complex regulatory requirements for engine manufacturers and advising vehicle manufacturers on emission-related risks and mitigation measures; influencing complex rule making to protect industrial and municipal boiler operators; and advising on strategic energy portfolio management issues in this complex and changing environmental regulatory landscape.
He also works closely with clients in the iron and steel sector and related mining sectors where he provides environmental legal services in the context of a deep understanding of his clients’ businesses.
Douglas’ mobile source experience includes regulatory counseling and enforcement defense for nonroad, marine and highway engine and vehicle manufacturers, with a focus on helping international companies navigate US standards.
He helped develop and implement strategies for regulatory relief through rulemaking for truck manufacturers facing new requirements for greenhouse gas reductions. He has substantial experience permitting new stationary source engines and advising manufacturers and operators on their emission-related regulations.
Douglas also has decades of experience working with municipal electric systems advising on the environmental regulatory implications for strategic planning, advocacy on rule developments at the state and federal levels, and providing regulatory counseling and enforcement defense. He also brings substantial knowledge and experience to his work with the iron and steel sector from iron mining to steel manufacturing on environmental matters.
Douglas recently provided oral argument before the DC Circuit Court of Appeals on federal rules governing hazardous air pollutants for boilers and process heaters and on sulfur dioxide emissions regarding the relative burden on iron and steel and electric utilities. He gains knowledge through the rulemaking process that is useful to help his clients navigate compliance options and enforcement risks.
Douglas has trial and appellate experience under the Clean Air Act and in the areas of hazardous waste litigation under the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) and related state law claims. He also serves as common counsel to PRP organizations and advises clients on strategies for brownfield disposition and redevelopment.
He has resolved civil and criminal enforcement matters on a full range of environmental issues before various administrative and judicial tribunals. Douglas is a member of the Section of Environment, Energy, and Resources of the American Bar Association, the Ohio Bar Association and the Cleveland Metropolitan Bar Association.
