Douglas W. Gilfillan focuses his practice on white collar criminal defense, cyber-crime and data breach responses, grand jury investigations, government regulatory investigations and enforcement actions, internal investigations, and complex civil litigation. A former federal prosecutor, Doug has acted as lead counsel and tried numerous cases to jury verdict in a wide variety of white collar criminal cases.

Prior to joining the firm, Doug served in the United States Attorney’s Office for the Northern District of Georgia, where he supervised and handled a wide variety of white collar criminal investigations and prosecutions. Most recently, Doug was Chief of the Cyber Crimes and Intellectual Property Section and National Security Cyber Specialist in the United States Attorney’s Office for the Northern District of Georgia.

In that role, he supervised the investigation and prosecution of computer intrusions and data breaches, intellectual property offenses, and counter-proliferation cases. Doug also consulted with companies and third parties regarding cyber legal issues and investigations. Prior to serving as the Chief of the Cyber Section, Doug was Deputy Chief of the Economic Crimes Section. In that role and as an Assistant U.S. Attorney, Doug supervised and handled investigations and prosecutions of securities and investment fraud, public company accounting fraud, criminal False Claims Act matters, matters arising under the Foreign Corrupt Practices Act (FCPA), mail and wire fraud, bank fraud, health care fraud, public corruption matters, criminal tax matters, federal program and government contracting fraud, and union and labor fraud cases, among other matters. As sole and lead counsel, Doug tried several multi-defendant, multi-week cases to jury verdict and handled the ensuing appeals in the Eleventh Circuit Court of Appeals.

While at the United States Attorney’s Office, Doug worked closely with the FBI’s cyber and white collar crime squads, cyber-crime agents with the Secret Service, and numerous other federal law enforcement agencies. In addition to serving as the Office’s liaison with the U.S. Securities and Exchange Commission (SEC), Doug worked closely with the SEC and other civil regulatory authorities in investigations and prosecutions involving parallel criminal and civil investigations and litigation.

Doug received the Department of Justice’s John Marshall Award, the Department of Justice’s highest award for attorneys, for his participation in the investigation and resolution of a significant health care matter, which resulted in a corporate guilty plea and financial penalties of several hundred million dollars. Doug also received the United States Attorney’s Office Award for Appellate Litigation and served as an instructor in the Department of Justice’s two-week nationwide trial training course for new Assistant United States Attorneys and Department of Justice prosecutors.

Doug began his legal career as an associate and then a partner in the Atlanta, Georgia headquarters of an international law firm where he was a member of its Special Matters and Government Investigations Group. Doug handled and worked on representations involving federal grand jury and government investigations, securities law matters, the Foreign Corrupt Practices Act (FCPA), the False Claims Act, civil fraud, civil RICO, environmental, healthcare, federal grant program, insurance, and regulatory matters. He litigated civil cases involving fraud and RICO allegations and environmental matters in federal and state courts.

  • *Investigation and global resolution of criminal charges and civil False Claims Act off-label promotion claims against a large pharmaceutical company resulting in a corporate guilty plea and criminal fine and forfeiture of several hundred million dollars.
  • *Investigated and prosecuted cases involving a wide variety of white collar federal criminal violations, including securities and investment fraud, criminal tax matters, public corruption, mail and wire fraud, and bank fraud.
