Douglas R. Sargent is a Partner in Locke Lord’s Litigation Department and a member of the Firm’s Class Action, Consumer Finance, and Business Litigation & Dispute Resolution practice groups. Doug’s practice focuses primarily on the representation of financial institutions and companies in both state and federal courts, as well as in arbitrations.
Doug has substantial experience in complex commercial and class action litigation and arbitrations in jurisdictions across the country. Doug regularly represents mortgage lenders, securitizers, servicers and other financial institutions in individual and class action lawsuits.
These lawsuits often involve claims under the Truth in Lending Act (TILA), the Real Estate Settlement Procedures Act (RESPA), the Fair Credit Reporting Act (FCRA), the Fair Debt Collection Practices Act (FDCPA), and the Home Affordable Modification Program (HAMP), as well as state law claims for fraud, breach of contract and breach of fiduciary duty.
Doug has significant experience representing clients in responding to class action and individual lawsuits asserting claims under the Telephone Consumer Protection Act. He has obtained favorable results for clients in these high-exposure cases, including orders of dismissal.
Doug handles complex litigation matters involving breach of commercial contracts, fraudulent business practices, and piercing the corporate veil and alter-ego liability in federal and state courts, as well as in arbitration proceedings.
Doug is well-versed in handling asset-based and real estate loan workouts for a number of banks and financial institutions. He assists clients in negotiating forbearance agreements, loan restructuring and liquidations, including sales pursuant to the Uniform Commercial Code. When necessary, Doug enforces his clients’ rights through foreclosure, replevin, injunction and other proceedings, especially when needed to avoid misappropriation of collateral and fraudulent transfers.
