Duwayne A. Carr is a managing associate in the Los Angeles office of Seyfarth Shaw LLP. As a member of the Labor and Employment Department, Mr. Carr focuses his practice on single-plaintiff discrimination, retaliation, harassment, and wrongful termination cases (in state and federal court) that allege violations of California’s Fair Employment and Housing Act, Title VII, the ADEA, the ADA, and other similar anti-discrimination statutes.

Mr. Carr also devotes a substantial portion of his practice to the defense of wage-and-hour class and collective actions under the California Labor Code and the Fair Labor Standards Act (FLSA). In wage-and-hour matters, Mr. Carr represents employers in state or federal court, as well as before the Division of Labor Standards Enforcement (DLSE), where he has handled multiple settlement conferences and Berman hearings on behalf of management.

Mr. Carr is also a member of the firm’s Health Care Fraud & Provider Billing Litigation Specialty Team and has experience representing health care plans and payors in health care reimbursement and provider billing litigation—either as plaintiff’s counsel or defense counsel—involving claims under ERISA, RICO, and state law, including the California Insurance Frauds Prevention Act.

Mr. Carr is an experienced litigator with substantial experience in all aspects of pretrial civil litigation, including depositions and discovery, fact development and witness interviewing, motion practice (including dispositive motions), mediation and settlement negotiation.

Mr. Carr knows how and when to position a case for early resolution through possible informal discovery and other means, but he also has significant experience litigating cases up to and through summary judgment. “Winning” a case always depends on the needs of the client, and Mr. Carr prides himself on keeping the “voice of the client” at the center of each strategic litigation move.

Mr. Carr advises businesses on various aspects of employment relationships from pre-hire screening to terminations. Areas of concentration include discrimination, wage and hour, contracts, severance, disability/reasonable accommodations, and harassment/internal investigations. He has represented and advised businesses across various industries, including education, food-service, health/hospitals, retail, technology, and transportation.

Mr. Carr engages in a substantial amount of pro bono legal work every year. He has represented individuals seeking asylum, and foster care parents seeking retroactive and prospective funding from the state to care for their foster children. In recognition of his years of pro bono service, in 2017, Mr. Carr and some of his colleagues were selected by the firm as 2017 Pro Bono Team of the Year for their years-long representation of a former inmate at Pelican Bay State Prison on a deliberate indifference Section 1983 claim.

The case resulted in one of the largest settlements for an inmate in state history. Mr. Carr serves on the Board of Chatsworth Hills Academy, Inc, which he also represents in litigation on a pro bono basis. Mr. Carr serves on the Leadership Team (a defacto Elder Board) of his local church, New City Church of Los Angeles.

While in law school, Mr. Carr served as a Judicial Extern for the Honorable S. James Otero of the United States District Court for the Central District of California, and he was the Editor-in-Chief of the Black Law Journal. Before law school, Mr. Carr taught Spanish at his former high school in Jamaica for four years, and headed the Spanish Department for most of his tenure.
