Edwin G. Schallert is a retired partner and currently of counsel to the firm. He was amember of Debevoise’s Litigation Department and former Co-Chair of its Securities Litigation practice. Mr. Schallert worked on complex civil litigation and regulatory inquiries, withsignificant experience in defending securities litigation and in representing life insurance companies in court and in regulatory matters.

Mr. Schallert was recognized as a leading lawyer by The Legal 500 US and Chambers USA (2016 & 2017), where he was credited with being “the gold standard,” an “outstanding writer and advocate” with a “strong sense of the market.”

Mr. Schallert was Chair of the Committee on Federal Courts of the New York City Bar Association from 1996 to 1998. While he was Chair, the Committee published the 8th Edition of the Handbook for Appeals to the Second Circuit. He is a member of the Pro Bono Panel of the Second Circuit. He is Chair of the Board of Directors of Measures for Justice, a non-profit developing a series of measures to gauge performance of the criminal justice system on a county-by-county basis. He is the author of chapters on “Life Insurance Claims” and “Annuities and Variable Contracts” in the Matthew-Bender Treatise, New York Insurance Law; “Market Timing in Variable Annuities: Trends in Regulatory Enforcement,” The Review of Securities & Commodities Regulation (May, 2007) and “Report of the Investigation,” American Bar Association, Section of Litigation, Internal Corporate Investigations, Brad D. Brian & Barry F. McNeil eds., 2d ed. 2003 (with Natalie R. Williams). He is admitted to the Bars of the U.S. Supreme Court; the First, Second, Third, Fifth, Seventh, Ninth and Tenth Circuits; and the Southern and Eastern Districts of New York.

Mr. Schallert joined Debevoise in 1983 and became a partner in 1989. Prior to joining the firm, he served as a law clerk to Associate Justice Thurgood Marshall, U.S. Supreme Court and to the Hon. J. Skelly Wright, U.S. Court of Appeals for the District of Columbia Circuit. From 1975 to 1978, he served as a legislative assistant to U.S. Representative Les Aspin in Washington, D.C.

Mr. Schallert holds an A.B. from Stanford University (1974) Phi Beta Kappa, a M.P.P. from the John F. Kennedy School of Government at Harvard University (1981) and a J.D. magna cum laude from Harvard Law School (1981), where he was Managing Editor of the Harvard Law Review.

Experience:

  • Allergan in defeating nationwide class certification of a putative class of third-party payors alleging violations of federal RICO statutes through fraudulent promotion of antidepressants.
  • Prudential Financial, Inc. in shareholder class action and derivative lawsuits arising from regulatory inquiries into death benefit payment practices and compliance with unclaimed property laws.
  • Prudential Retirement in a successful two-week trial in the Southern District of New York of ERISA claims against State Street as an investment manager of bond funds, finding $77 million in damages.
  • Successful appeal in the United States Court of Appeals for the Second Circuit reversing a $65 million judgment arising from an alleged oral agreement to sell securities.
  • Large life insurance companies in state regulatory inquiries concerning abandoned property and claims handling, as well as in related qui tam lawsuits and a policyholder class action.
  • Learning Annex in obtaining a $23 million judgment after a jury trial of quasi-contract claims in the Southern District of New York.
  • Markel Corporation in its $3.13 billion acquisition of Alterra Capital Holdings, a listed Bermuda reinsurer.
  • The former President of North America sales for Lucent in litigation with the Company and the SEC.
