Ephraim J. Pierre is an associate in the Labor & Employment Department in the New York office of Seyfarth Shaw LLP. Mr. Pierre’s practice focuses on complex employment litigation, defending management against discrimination, harassment, and retaliation claims under federal, state and local anti-discrimination laws, wage and hour collective and class actions under the federal Fair Labor Standards Act and state analogues, consumer class actions under the federal Fair Credit Reporting Act and state analogues, and breach of contract and related theories.
Mr. Pierre has extensive experience with single-plaintiff and class action employment litigation before New York and New Jersey state and federal courts and administrative agencies, including taking and defending depositions, briefing summary judgment, conducting declaration campaigns, briefing post-judgment and interlocutory appeals, and negotiating settlement agreements.
Recently, Mr. Pierre won summary judgment dismissing interference and retaliation claims under the FMLA for a Fortune 15 company, won dismissal of class action claims under the FCRA and the New Jersey FCRA for an international retailer, and won a motion to compel arbitration for a Fortune 60 company.
Additionally, Mr. Pierre has trial experience before New York and New Jersey state and federal courts, and has significant experience with FINRA arbitration proceedings. Mr. Pierre also provides clients with legal and practical advice on various workplace issues, including hiring practices, internal complaints and investigations, background screening, unemployment insurance, FMLA and ADA compliance, and employee handbooks.
Mr. Pierre represents clients in many industries, including financial services, hospitality, energy, and retail. Mr. Pierre has also completed Seyfarth’s Retail University and is now a certified member of Seyfarth’s Retail Industry Client Team.
Mr. Pierre currently serves as a member of Seyfarth’s New York Diversity Action Team, and regularly represents non-profit organizations in a variety of pro bono matters. Mr. Pierre was selected as a 2017 Pathfinder for the Leadership Council on Legal Diversity. Mr. Pierre also serves as an attorney mentor with Legal Outreach, Inc.
Mr. Pierre joined Seyfarth as a member of the innovative Summer and Senior Fellowship programs. Prior to joining Seyfarth, Mr. Pierre served as a senior legal and public policy assistant for the Nassau County Legislature.
