Eric J. Berardi focuses his practice on the representation of financial institutions and special servicers in connection with distressed real estate loans (including the pursuit of foreclosure, deed-in-lieu of foreclosure and receivership remedies), the representation of companies in the disposition of office, retail and multifamily housing properties and the representation of financial institutions in the creation and administration of credit facilities.

Experience:

• Represented a CMBS special servicer on the modification of a $96 million loan secured by an office tower in New Jersey.
• Represented a CMBS special servicer on the modification of an $80 million loan secured by a franchised hotel in Georgia.
• Represented a CMBS special servicer on the appointment of a federal receiver on a $67 million loan secured by six franchised hotels in five states and the disposition of the hotels via federal receivership sales.
• Represented an institutional equity fund in the sales of 10 multifamily apartment projects located in Georgia and Florida having an aggregate value in excess of $700 million.
• Represented an S&P 500 publicly traded REIT in connection with the sales of over 80 conventional and affordable multifamily residential properties nationwide.
• Represented a CMBS special servicer on the appointment of a federal receiver on a $187 million loan secured by eight franchised hotels in six states.
• Represented one of the largest worldwide leaders in financial services as administrative agent and lender in connection with the provision of a U.S. $1.30 billion syndicated financing to a North American owner, operator and developer of wireless communications towers.
• Represented one of the largest worldwide leaders in financial services as administrative agent and lender in connection with the provision of a U.S. $1.15 billion syndicated financing to a leading owner and operator of communications sites for the wireless and broadcast industries.
• Represented a major U.S. financial institution, as co-agent and lender, in connection with the provision of a $1.3 billion syndicated senior secured credit facility for a national cellular telephone tower owner.
• Represented a major U.S. financial institution, as administrative agent and lender, in connection with the origination of a $140 million real estate loan secured by 16 assisted living and skilled nursing facilities located in Florida.
• Represented a major U.S. financial institution as lender in connection with the origination of a $40 million real estate loan secured by 13 skilled nursing and assisted living facilities located in Georgia and South Carolina.
