Frederick D. Hyman is a partner in Mayer Brown’s Restructuring, Bankruptcy and Insolvency group. Rick’s practice focuses on the representation of domestic and foreign lenders in connection with all aspects of large and complex Chapter 11 reorganizations and out-of-court restructurings and recapitalizations, He packages the skills of an artful finance lawyer with those of a forceful litigator to efficiently represent his various clients.

Rick has extensive recent experience representing agents and lending syndicates in some of the largest energy bankruptcies of the last few years, including representing the agents in the Chapter 11 cases of Ultra Petroleum and Midstates Petroleum, both E&P companies that filed for bankruptcy in 2016.

Rick has also represented a number of overseas lenders in the Chapter 11 bankruptcies of their foreign-based borrowers. These have included engagements by the largest lender to a Taiwanese shipping company, TMT Shipping and its affiliates, which filed Chapter 11 in Houston despite having few assets located in the US.

Similarly, Rick represents one of the largest lenders to a Hong Kong-based fishing business with operations in jurisdictions across the globe that filed Chapter 11. In addition to a broad range of out-of-court restructurings, he is representing creditors in connection with the Westinghouse and Toys “R” Us bankruptcies.

Rick also has experience representing debtors and was one of the leading lawyers involved in the Firm’s representation of ATP Oil & Gas in its Chapter 11 case. Among other things, Rick was instrumental in negotiations with respect to the negotiations regarding the debtor-in-possession financing and the ultimate purchase and sale of the company’s assets.

He also led the firm’s representation of True Temper in its successful pre-packaged bankruptcy case. In addition to his work for creditors, Rick frequently represents stalking-horse and other bidders in connection with the acquisition of distressed assets, both in and out of bankruptcy proceedings.
