Gavin D. George’s practice covers technology transactions, privacy and data security, and intellectual property in the information age. He regularly drafts and negotiates contracts and other documents involving the license, acquisition, and distribution of: software, hardware, protected data, personal information, technology, patents, brands and creative works.
He is knowledgeable about cross-border data transactions and international data privacy issues, including the EU-U.S. Privacy Shield and the EU General Data Protection Regulation (GDPR). Gavin has advised a number of large U.S. and international companies across a variety of industries, including the health care, airline, hotel, pharmaceutical, railway, energy, and entertainment industries. Gavin earned the designation of Certified Information Privacy Professional (CIPP/US) in 2014.
Gavin facilitates business transactions involving the licensing, development, and transfer of software, data, and other technology for large and small companies. He handles commercial software licenses, technology development agreements, information technology services contracts, software-as-a-service (SaaS) agreements, distribution agreements, cloud computing arrangements, and other outsourcing deals.
He has significant experience related to open source software, cloud platforms, sensitive data, social media accounts, as well as the development of new software, mobile apps, video games, and websites. Gavin counsels clients on a wide range of compliance and transactional issues related to privacy and data security.
He is highly proficient in the following areas: privacy policy drafting, compliance with federal and state privacy and data protection laws, FTC enforcement, data breach preparedness, data breach notice obligations, mobile tracking technology, HIPAA data privacy and security rules, and the Children’s Online Privacy Protections Act (COPPA). Relatedly, Gavin advises on the compliance of customer communications with the Telephone Consumer Protection Act (TCPA) and the CAN-SPAM Act.
Gavin consults on general patent, copyright and trademark protection and privacy matters. He also regularly advises on the intellectual property, privacy, data transfer and technology issues that arise in corporate mergers, acquisitions, spin-offs, and bankruptcies. In addition to his law degree, Gavin holds a B.S. in chemical engineering.
