Gregory M. Sergi is a litigation associate focusing on antitrust issues and complex civil litigation. His practice primarily involves antitrust counseling, litigation, and merger-related issues. He has represented clients in a wide range of industries, including entertainment, cable television, fashion accessories, medical devices, office equipment, pharmaceuticals, private equity and telecommunications.

Mr. Sergi frequently counsels clients on antitrust issues related to pricing, supply and distribution agreements, and the licensing of intellectual property rights.

Key Representations :

  • Brighton Collectibles, Inc. (formerly Leegin Creative Leather Products), in the defense of a class action in Kansas related to claims of resale price maintenance.
  • EIG Global Energy Partners, in obtaining a preliminary injunction related to the acquisition of TCW by the Carlyle Group.
  • Universal Music Group, in obtaining approval by the FTC for its acquisition of EMI.
  • GE Capital, in the defense of antitrust claims related to the leasing of copier equipment.

Mr. Sergi has contributed to a number of publications, including sections of the ABA’s antitrust treatise on remedies in civil antitrust litigation and the Robinson-Patman Act. He also is the author of sections about the CAN-SPAM Act in the ABA’s Consumer Law Developments annual updates. Currently, he is drafting a chapter related to tying and bundled discounts for a future publication.

Prior to joining Munger Tolles, Mr. Sergi was an associate in the Washington, DC office of Cleary Gottlieb Steen & Hamilton. While there, Mr. Sergi was involved in a number of major antitrust matters, including representing Deutsche Telekom and T-Mobile in the proposed acquisition by AT&T, and representing clients in price-fixing investigations and class action litigation.

Mr. Sergi received his law degree, magna cum laude, from Duke Law School in 2007. He subsequently clerked for Judge D. Brock Hornby of the United States District Court of Maine and Judge Pamela A. Rymer of the United States Court of Appeals for the Ninth Circuit.

Mr. Sergi is admitted to practice in California and the District of Columbia. He is also a member of the American Bar Association’s Antitrust Committee.
