Hallman B. Eady is a general and commercial litigator with a current focus on the representation of financial institutions. He regularly advises banks and mortgage servicers regarding recoupment options including lien rights, closing errors, title insurance, mortgage insurance and correspondent/broker agreements. Hall has also represented construction companies and product manufacturers.
Hall has been named as one of the Best Lawyers in America since 2015 in the Commercial Litigation category. This distinction recognizes the substantial work he has performed for corporate and financial services clients, including the successful negotiation and litigation of hundreds of real property and insurance claims.
As the lead member of the firm’s Title Insurance Group, Hall has recouped millions of dollars for his clients. In New Jersey, Georgia, South Carolina and Florida, he has litigated the scope of closing protection letters for the benefit of lenders.
He is also an active member of the American Bar Association’s Title Insurance Litigation Committee and has presented on issues from the lender’s perspective.
As part of his more general commercial litigation practice, Hall has represented construction companies against large claims for negligent construction; insured businesses in pursuit of indemnity from their insurers and insurance brokers; lenders in pursuit of downstream losses from correspondent lenders and mortgage brokers; clients against auditors for losses caused by improper audits; companies against claims of minority shareholder oppression; and businesses in pursuit of real property development and title curative work.
