Heather C. Giordanella has worked extensively on a variety of matters involving special master services and business and consumer protection disputes. For many years, she assisted Special Master Gregory P. Miller (retired), who was appointed to oversee discovery in thousands of federal cases transferred to the U.S. District Court for the Eastern District of Pennsylvania for coordinated and consolidated pretrial proceedings in the In Re: Diet Drugsproducts liability litigation.
In this role, Heather developed discovery procedures, resolved discovery disputes, and acted as a liaison between the district court and various parties. Recently, the district court appointed her to serve as the Special Master as the litigation and activities of the related settlement trust continues.
Heather has assisted clients in defending against allegations of consumer protection and state qui tam claims, and litigating real estate, breach of contract, breach of fiduciary duty, and tortious interference claims. She has also handled various construction and contractor disputes and defended against claims to enforce mechanics’ liens.
In addition, Heather has experience evaluating claims against ERISA plan fiduciaries, and she helped an ERISA regulated employee benefits trust secure its right to operate a self-insured, risk-assuming preferred provider organization.
