Hillary Massey is an associate in the Labor & Employment department of Seyfarth Shaw LLP. Ms. Massey represents management in a range of employment-related matters, with a focus on complex wage and hour litigation and equal pay counseling.
Ms. Massey focuses a significant share of her litigation practice on the defense of complex wage and hour claims, including collective actions under the federal Fair Labor Standards Act and class claims under the laws of Massachusetts and other states. She has extensive experience defending against allegations of exempt employee misclassification, independent contractor misclassification and off-the-clock work, including early-stage motion practice, class action certification and summary judgment.
Ms. Massey also represents management against all types of discrimination, harassment and retaliation claims, including those asserted under Title VII of the Civil Rights Act of 1964, the Americans with Disabilities Act, the Age Discrimination in Employment Act, the Family and Medical Leave Act, Massachusetts’ Chapter 151B, and other state laws.
In her counseling practice, Ms. Massey works with in-house counsel and human resource personnel on a variety of employment-related legal issues, including all aspects of employee compensation, terminations, performance counseling, leaves of absence, and accommodations. Ms. Massey’s recent work is focused on compliance with the various state and local equal pay laws and salary history bans, with a goal of identifying practical employment practices that comply with the laws.
Before law school, Ms. Massey served in the U.S. Army Reserve in the Medical Service Corps and volunteered with the U.S. Peace Corps in Zambia. After law school, Ms. Massey clerked at the Supreme Judicial Court for Chief Justice Margaret H. Marshall and at the U.S. District Court in Boston for Judge William G. Young.
