James Daniel Gardner

James Daniel Gardner’s primary focus has been assisting in managing and trying the firm’s heavy caseload of certain smoking-and-health cases in Florida known as the Engle-Progeny litigation.

He has represented Shook’s client in dozens of Florida cases pending in both state and federal court, including cases in South Florida, the panhandle and the Jacksonville area.

Dan has been involved in all aspects of the Engle-Progeny litigation from discovery to trials and appeals. He has significant hearing experience, including procedural and substantive oppositions to efforts to bring claims for punitive damages.

Dan also has significant fact and expert deposition experience. Dan has been a valuable member of more than 20 trial teams for cases in which plaintiffs were seeking multimillion-dollar awards in both compensatory and punitive damages.

Prior to entering law school, Dan worked as an associate at Price Waterhouse Coopers in their Columbus, Ohio, office. While at PWC, he worked on federal and state tax matters for individuals and corporations.
