James T. Bailey helps clients manage and solve those challenges, particularly concerning long-term care mergers and acquisitions. He regularly assists investors, owners and operators with skilled nursing, assisted living, continuing care retirement community and independent living transactions.

The challenges health care transactions present are often atypical and more complex than with any other deals. Jim provides clients with an understanding of long-term care regulatory issues such as licensure, reimbursement and operations transfer, and he also helps clients work through their financing and lending options with commercial banks and the Department of Housing and Urban Development (HUD).

Aside from his transactional work, Jim assists health care clients with False Claims Act matters. He advises clients as they encounter investigations, civil investigative demands (CIDs) and false claims litigation. Jim knows dealing with the U.S. Attorney’s Office can be daunting, and he leverages his experience to help clients, including on matters involving complex coding and billing issues.

Jim also advises covered entities and business associates on HIPAA matters. He assists clients with HIPAA policies and procedures, breach notifications, security risk assessments and HIPAA audit preparation. Jim stays current on HIPAA matters and speaks regularly to industry leaders about HIPAA.

Jim remains active in both the Richmond and Hampton Roads communities. He was recently elected as the chair of the American Heart Association’s Young Professionals Board, and he serves as an advisory board member to the Railroad Museum of Virginia. As an Eagle Scout, he enjoys volunteering with the Boy Scouts of America and teaching the law merit badge.

Jim graduated, with honors, from the University of Virginia, where he was a teaching assistant for Kenneth W. Thompson’s Normative Theories of International Relations. He received his law degree from the Washington and Lee University School of Law, where he was the president of his class and served as a student advisor to the Dean. Prior to practicing law, Jim managed four Virginia political campaigns, including two U.S. Congressional campaigns.
