Jamie L. Graham focuses her practice on intellectual property issues involving biological and chemical technologies. Ms. Graham conducts domestic and foreign biological and chemical patent prosecution, particularly in the areas of biotechnology, diagnostics, isolation and purification methodology, immunology and pharmaceuticals. She renders patentability, patent validity and freedom-to-operate opinions; performs intellectual property due diligence; and provides advice to clients regarding various aspects of intellectual property, including inventorship determinations, licensing, transactions, pre-litigation and litigation strategies.

Ms. Graham has provided intellectual property advice and services to universities, large corporations, small start-up companies and government entities and has been awarded federal and state contracts for patent legal services.

Ms. Graham has been a registered U.S. Patent Attorney since 1986. Prior to joining the firm, she served as in-house patent counsel for a pharmaceutical company. She has conducted enzyme isolation and characterization research at Sloan-Kettering Institute for Cancer Research and cardiac and allergy drug dispositon/metabolism research at Boehringer Ingelheim Ltd. Ms. Graham also performed graduate research in neuroimmunology and virology (HIV research conducted at the Centers for Disease Control and Prevention). She has been an adjunct professor of Intellectual Property Law at Emory University.

Ms. Graham was listed in The Best Lawyers of America® for Biotechnology and Life Sciences Law and Patent Law in 2019 and each of the 20 years immediately preceding. She was also named a 2012 and 2013 “Atlanta Lawyer of the Year” in the area of Biotechnology Law by The Best Lawyers in America®. Ms. Graham was listed in The International Who’s Who of Business Lawyers for Life Sciences in 2015, The International Who’s Who of Business Lawyers for Patents in 2013, and The International Who’s Who of Patent Lawyers in 2011. Ms. Graham has been recognized as one of Georgia Trend’s 2012 “Legal Elite” for Intellectual Property Law. She was honored by the Georgia Chapter of the Huntington’s Disease Society of America at its 2012 Celebration of Hope Gala. Ms. Graham is a recipient of the prestigious 2015 Georgia Bio Community Award for her significant contributions to Georgia’s life sciences industry.

Experience:

  • Represents Oklahoma Medical Research Foundation (OMRF) in the preparation and prosecution of patent applications involving anthrax vaccines, magnetic resonance spectroscopy and metabolite detection.
  • Obtains patents and provides patent counseling for Strategic Diagnostics Inc. (“SDI”).  SDI is a leading developer and manufacturer of antibodies, immunoreagents and immunoassay-based test kits for both field testing and laboratory use.
  • Represented start-up in successfully obtaining U.S. patents for immunodiagnostic assays for early detection and profiling of cancer patients.
  • Expert witness for global veterinary medicine corporation in litigation involving an animal vaccine.
  • Represented public health agency in patent prosecution and counseling matters. Prepared and prosecuted patent applications in a variety of biotechnical areas including vaccine and pathogenic organism detection.
  • Represented a Fortune 500 scientific, engineering, and technology applications company  in virus and pathogenic organism micro array detection. The firm worked closely with the company on bioterrorism detection and the Anthrax clean-up in DC.
  • Represents the National Institutes of Health under government contract and conducts patentability analysis and prosecutes patent applications for government entities such as Centers for Disease Control and Prevention (CDC), and National Cancer Institute (NCI) in biological technologies such as diagnostics, antibodies, vaccines and cancer treatments.
  • Represents the University of Connecticut under government contract and prosecutes patent applications for biological and chemical technologies such as protein-based photovoltaic energy systems, anti-malarial vaccines, and chemical compounds for the inhibition of yeast growth.
  • Represent the U.K. Ministry of Defence (MOD), which is responsible for the military and homeland security functions of the United Kingdom, and have prosecuted patent applications for aerospace, defense, biotechnology and chemical technologies. Also represents the technology transfer company affiliated with the MOD whose mission is to commercialize technologies having non-military applications.
