Jason J. Mendro is a partner in the Washington, D.C. office of Gibson, Dunn & Crutcher LLP, where he practices in the firm’s Litigation Department.  Mr. Mendro has extensive experience defending class and derivative action lawsuits at the trial and appellate level.  Mr. Mendro recently earned national acclaim, being named “Litigator of the Week” by The American Lawyer, for his role in winning dismissal of a major data breach class action.

Mr. Mendro authors a chapter of a leading treatise on securities litigation and is a member of the Steering Committee of Gibson Dunn’s Securities Litigation Practice Group, which is consistently ranked as one of the top securities litigation practices in the country.

Mr. Mendro has defended numerous securities class actions and shareholder derivative actions.  Mr. Mendro played a leading role in the following representations, among others:

  • Winning dismissal of a securities class action assailing a biotechnology company’s public statements about the development of its products;
  • Winning dismissal of class actions challenging a merger that created the world’s largest hotel company;
  • Winning dismissal of two underwriters from a securities class action arising out of a disputed stock offering by a real estate finance company;
  • Winning dismissal of derivative litigation arising from the announcement of a leading government contractor’s deferred prosecution agreement with the U.S. Department of Justice;
  • Winning dismissal of a derivative action claiming that the board of directors of a major pharmaceutical company improperly awarded executive compensation that did not qualify for certain tax deductions; and
  • Winning dismissal of a derivative action accusing executives of a top technology company of backdating stock options.

Mr. Mendro has also defended complex litigation involving a broad spectrum of other disputes, including data breach litigation and claims under the Fair Debt Collection Practices Act, the Employee Retirement Income Security Act, the Fair Labor Standards Act, and whistleblower protection laws.

He has conducted internal investigations, represented special litigation committees, and defended companies in investigations and actions by the Consumer Financial Protection Bureau, the Securities and Exchange Commission, self-regulatory organizations, and large coalitions of state attorneys general.

Mr. Mendro also has significant experience in appellate litigation and challenges to administrative rulemakings.  Among other matters, Mr. Mendro was a key contributor to successful challenges to controversial regulations with sweeping implications for the global swaps market, as well as a precedent-setting appellate victory that reversed a multi-million-dollar jury verdict under the False Claims Act.

Mr. Mendro graduated cum laude from Harvard Law School.  He earned a bachelor’s degree from the University of Florida, where he graduated first in his class.  Mr. Mendro also served as a law clerk to the Honorable Gerald B. Tjoflat of the United States Court of Appeals for the Eleventh Circuit.

Mr. Mendro is admitted to practice law in Washington, D.C., New York, California, and numerous federal courts, including the Supreme Court of the United States and the United States Courts of Appeals for the First, Second, Third, Fourth, Seventh, Ninth, Eleventh, and D.C. Circuits.
