Jay also has significant experience in federal trial and appellate courts, and before federal agencies such as the United States Department of Agriculture, the United States Department of Transportation Federal Highway Administration, the Surface Transportation Board, the Environmental Protection Agency, the United States Army Corps of Engineers and the Advisory Council on Historic Preservation.

Jay’s experience covers a wide range of environmental laws, including the National Environmental Policy Act, the Clean Water Act and the National Historic Preservation Act, in addition to a variety of substantive federal statutes. He has a proven track record of effectively helping clients navigate opposition to major projects that involves these laws.

Experience :

  • Represented client in U.S. District Court and U.S. Court of Appeals defending NEPA and CWA challenge to U.S. Army Corps of Engineers permit for intermodal rail facility.
  • Represented clients in filing amicus briefs in U.S. District Court, U.S. Court of Appeals and U.S. Supreme Court regarding NEPA challenge to deregulation of genetically modified crops.
  • Represented client in U.S. Court of Appeals petition for review of Surface Transportation Board decision approving construction of rail line extension.
  • Represented client before Advisory Council on Historic Preservation in connection with dispute over interpretation of Programmatic Agreement entered into under Section 106 of the National Historic Preservation Act.
  • Represented client in obtaining permits for new rail line from U.S. Army Corps of Engineers and Bureau of Land Management.
  • Represented client in three-week U.S. District Court trial regarding the scope of CERCLA and RCRA liability, and ensuing appeal challenging validity of Consent Decree negotiated after trial.
  • Represented client in seeking permit from U.S. Army Corps of Engineers for construction of new rail line.
