Jeffrey Kuhn focuses his practice on energy and environmental matters, large project development, and complex commercial litigation, including judicial and administrative trials and appeals. Jeff is also regularly called upon by domestic and international clients to handle matters involving environmental due diligence and review, regulatory compliance, defense of government enforcement actions, and negotiation of energy and fuel supply agreements.
Jeff has been counsel on several project development, compliance, and litigation matters of national and international significance. He has represented major energy and utility companies on permitting, planning, government relations, governmental initiatives and potential litigation associated with renewable energy facilities, transmission infrastructure development, conventional and unconventional oil and gas production, and climate change matters.
Jeff successfully represented a leading interstate natural gas pipeline company in a National Environmental Policy Act case before the US Court of Appeals for the Second Circuit challenging approvals issued to the company by the Federal Energy Regulatory Commission.
He has also represented a multinational joint venture on the permitting, environmental impact review and federal judicial and administrative appeals relating to the construction of a liquefied natural gas facility. Jeff also successfully represented major energy facilities in judicial appeals of state discharge permits, including litigation of the issue of the “best technology available” for cooling water intake structures.
Jeff regularly counsels clients undertaking significant projects on permitting and environmental impact review requirements under state, federal and international law. Among his clients are Fortune 500 companies and governments such as the Kingdom of Saudi Arabia.
Jeff’s diverse complex commercial litigation practice encompasses a wide variety of matters in state and federal trial and appellate courts, including securing a victory for a Moroccan energy company in a multi-million dollar international case to prevent the drawdown on a letter of credit, numerous intricate contract disputes, and cases involving real property and mineral rights.
