Jennifer Lin

Jennifer Lin is an Associate at Fragomen’s Santa Clara office, where she counsels international and domestic corporations, multinational companies and professionals on their immigration-related needs.

Experienced in U.S. immigration and nationality law, Jennifer advises multinational companies seeking nonimmigrant and immigrant visas for their employees, including H-1B visas for employees; L-1A/B visas for executives, managers and individuals with specialized knowledge; NAFTA professionals; and multinational managers and executives.

Prior to joining Fragomen, Jennifer served as an Associate at a boutique immigration law firm in Los Angeles. She focused on investor immigration, and gained experience in representing institutions of higher education through analyzing, preparing and reviewing extraordinary ability, outstanding researchers/professors and national interest waiver petitions.

Jennifer counseled clients through all stages of the process for obtaining permanent residence and citizenship. She has also represented individuals before the U.S. Immigration Courts.

Jennifer’s pro bono experience includes representing a Special Immigrant Juvenile client before the California Probate Court and USCIS, and a military parole in a family-based immigration matter.

During law school, Jennifer interned at a nonprofit organization, where she worked with Violence Against Women Act and U Visa applicants.

She also participated in an immigration law clinic, where she successfully obtained asylum for a client from Honduras.

Jennifer speaks English, Mandarin Chinese and Spanish.

EXPERIENCE:

• Responded to complex Requests for Evidence for employment-based fifth preference petitions for immigrant investors, and employment-based first preference petitions for individuals of extraordinary ability.
• Analyzed adjustment of status eligibility of EB-5 applicants to whom INA 245(k) was not applicable.
• Analyzed the application of the Child Status Protection Act for dependents who were at risk of aging out.
• Prepared and filed employment-based first preference petitions for individuals of extraordinary ability, outstanding researchers/professors, as well as employment-based second preference petitions.
• Counseled clients on various issues relating to immigrant visa processing and consular communications.
