Jerome C. Roth , a litigation partner at Munger, Tolles & Olson resident in its San Francisco office, is a trial lawyer specializing in business and international litigation and arbitration, as well as white collar criminal defense and investigations. He has been widely recognized for the breadth and depth of his practice, the high profile of his matters and the results obtained for his clients.
In the business litigation area, Mr. Roth has defended large-scale intercompany commercial disputes; securities fraud, antitrust, RICO, privacy and consumer class actions; and intellectual property cases including trade secret misappropriation and trademark matters. He has represented Berkshire Hathaway, Intel, LinkedIn, LG Display, Northrop Grumman, Occidental Petroleum, PepsiCo, Shell Oil, Verizon and Warner Bros.
Mr. Roth is an active member of the international litigation bar and has represented European, Asian and Latin American clients in criminal and civil litigation matters, as well as U.S. companies in matters abroad. He is an ICC-trained international arbitration lawyer and has handled arbitrations and mediations before a range of arbitral tribunals. He speaks French, Spanish and Italian and works in German and Portuguese.
Mr. Roth is the President-Elect of the Paris-based Union Internationale des Avocats, the world’s oldest and most multicultural international law association, and he has been the co-chair of the ABA Litigation Section’s International Litigation Committee. Mr. Roth holds a French-language master’s degree in European business law from the Université de Paris (Paris II, Assas). In 2007, Mr. Roth was among a handful of ABA members who spearheaded a program to train Sudanese lawyers to represent victims of the Darfur tragedy before the International Criminal Court, and he has trained lawyers in Haiti, Brazil and elsewhere around the globe. He lectures frequently on international aspects of U.S. litigation, both in the U.S. and abroad.
As a former federal prosecutor in New York, Mr. Roth also specializes in white collar criminal defense and related matters such as SEC enforcement actions and internal corporate investigations and he frequently represents individual executives as well as corporations, with special emphasis on FCPA and international matters. His clients include:
- Several major U.S. and foreign corporations in FCPA investigations.
- The former CFO of a technology company in a stock options backdating SEC and DOJ investigation.
- Schwab in the SEC’s after-hours trading and market timing investigation.
- A defense contractor in a multi-agency government investigation into alleged theft of trade secrets from a competitor.
- A software executive and various companies in DOJ/SEC investigations into FCPA violations.
- The Special Committee of Whole Foods in an independent investigation into postings on internet financial message boards.
While at the Department of Justice, Mr. Roth received the Director’s Award for Superior Performance and a Special Commendation for Outstanding Service. He is a former chair of the Northern California branch of the ABA’s White Collar Crime Section.
Mr. Roth is an active member of the San Francisco and Sonoma communities and has sat on the board of directors of the French American International School and of the San Francisco Child Abuse Prevention Society. He is the current president of the Board of Directors of Opera Parallèle, San Francisco’s contemporary opera company.
Mr. Roth graduated magna cum laude in 1979 from Harvard College and magna cum laude in 1983 from Harvard Law School, where he served as an editor of the Harvard Law Review and wrote his student note on the applicability of the RICO statute to commercial disputes. He clerked after law school for U.S. District Judge William Schwarzer in San Francisco.
